Additional Conditions

• ANNEX 1 - MANDATORY CONDITIONS

   

  (1) The first condition is that no supply of alcohol may be made under the premises licence: -

  (a) At a time when there is no designated premises supervisor in respect of the premises licence, or

  (b) At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Door supervision

   

  (1) Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each such individual must be licensed by the Security Industry Authority.

   

  (2) But nothing in subsection (1) requires such a condition to be imposed-

  (a) in respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c.12) (premises with premises licences authorising plays or films), or

  (b) in respect of premises in relation to-

  (i) any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or

  (ii) any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).

   

  (3) For the purposes of this section-

  (a) "security activity" means an activity to which paragraph 2(1)(a) of that Schedule applies, and

  (b) paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  a) General

   

  1.              Training of staff appropriate to their role by a personal licence holder

  2.              Supervision of staff by a personal licence holder

  3.              Adequate staffing levels

  4.              Staff banned from drinking on duty

  5.              Recording of any material incidents within or in immediate vicinity of premises

  6.              Drug awareness training for all staff

  7.              Zero tolerance to drugs use and dealing

  8.              Access to legal advice on all licensing issues

  9.              Membership of Plymouth City Safe scheme and Pubwatch etc.

  10.              Banning policy for customers who misbehave in or within in the vicinity of premises where deemed necessary and appropriate

  11.              Support for Exclusion/Banning Orders

  12.              Staff dress code

  13.              Dress code for customers

  14.              Availability of soft drinks, non-alcoholic and or low alcohol beverages at all times

  15.              Food served

   

  b) The Prevention of Crime and Disorder

   

  1.              Specific staff training and supervision in assessment of customer consumption and condition

  2.              No drink promotions or package deals

  3.              No drinks hoarding

  4.              Pro-active policy against "binge" drinking

  5.              Zero tolerance to offensive conduct

  6.              Toughened glassware for draught products

  7.              Regular glass collection

   

  c) Public Safety

   

  1.              No smoking throughout premises

  2.              Regular inspection of electrical installation, fire fighting equipment, gas installation and emergency lighting

  3.              Adequate toilet facilities to at least minimum hygiene standards

  4.              Staff training in al least minimum hygiene standards

  5.              Regular dedicated cleaning of premises

  6.              Specific Food Hygiene Standards complied with

  7.              Health and safety risk assessments for staff and customers

  8.              Disabled Facilities - ramps, lift and disabled toilet

  9.              Staff assistance for disabled customers

  10.              Limit on number in premises to 500

   

   

  d) The Prevention of Public Nuisance

   

  1.              The overriding control of level of sound from amplified and live music

  2.              Advisory notices ref. noise outside the premises and on leaving the premises

  3.   Advisory notices requesting customers not to take glasswear outside the premise

  4.              Freephone taxi facility

  5.              Management and senior staff to deal with complaints from neighbours

  6.              ‘Open door’ policy towards neighbours

  7.              CCTV and/or regular monitoring of external areas of premises at night

  8.              Awareness of sensitive and local residential properties

   

   

  e) Protection of Children from Harm

   

   

  1.  No entry to anyone under 16 unless accompanied/lsupervised by an adult

   

   

   

  CONDITIONS AGREED WITH THE POLICE LICENSING DEPARTMENT

   

  a)              General

   

  1.              Whenever the Designated Premises Supervisor is not at the premises another person will be nominated by the Designated Premises Supervisor as being the person to manage the premise

   

  b)              Prevention of Crime and Disorder

   

  1.              CCTV cameras to be kept clean and maintained at all times

  2.              CCTV images will be retained for a minimum of 30 days

  3.              The CCTV system will have the capability of downloading the images to a recognised format

  4.              A register will be kept detailing all requests by relevant authorities for CCTV images.  This will include time and date of request, time, date and location of incident, time and date of hand on to relevant authorities

  5.              During trading hours, there will be members of staff present who are trained to view and download images from CCTV at request of relevant authorities

  6.              The Police Licensing Department will be informed if the CCTV system is not working

  7.              A daily incident logbook detailing all incidents of note at the premises or in the immediate vicinity e.g. slips, accidents, entry refusals and incidents of disorder etc. The log will detail the date, time, type of incident, brief circumstances, action taken and person dealing.  The logbook will be made available for up to six months to the Police or any responsible authority for inspection, if required.  All relevant incidents will be reported to the police at the earliest opportunity

  8.              Police Officers will be afforded all possible assistance in the course of their investigations that relate directly to the premise

  9.              All material evidence resulting from a criminal incident will be preserved for Police forensic examination

  10.              Any function will be risk assessed for the need of door supervisors

  11.              A separate register will be maintained recording any details of door supervisors working at any time.  It will include date, name, SIA registration number, expiry date of licence, the time duty commenced and time duty ceased

  12.              No open bottles or other vessels to be permitted to be taken from the premises

  13.              All staff and managers will be made aware of the conditions attached to the licence

   

  c)              Protection of Children from Harm

   

  1.              Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:

   

  UK photo driving licence

  Passport

  PASS accredited cards

   

  2.              Notices obtained from Police publicising the Challenge 21 initiative shall be clearly displayed at the bar entrance and behind the bar at all times

  3.              Regular training of staff in relation to the prevention of under age sales, responsibilities of staff in monitoring customers consumption of alcohol, selling alcohol to drunks and  drug awareness

  4.              Documentation recording the time, date, subject and duration of training shall be kept. This will include the persons attending and the person delivering the training

  5.              This documentation will be retained for a periods of 2 years and produced to any relevant authority on request

   

               

                              There will be no adult entertainment allowed at this premises

  As Attached
