ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Conditions agreed with Environmental Health Authority
Public Nuisance
1. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring premises at the start of the activity/entertainment and periodically throughout the activity/entertainment and take action to reduce noise levels if they are found to be excessive/distinguishable above background levels at the nearest residential property.
2. Before 23:00 hrs
To prevent entertainment being intrusive, noise emanating from the premises will not be clearly audible 1 metre from the façade of the nearest residential property.
3. Between 23:00 hrs & 00:00 hrs
To prevent entertainment being intrusive, noise emanating from the premises will not be clearly distinguishable above other noise 1 metre from the façade of the nearest residential property.
4. Between 00:00 hrs and 02:00 hrs
Noise emanating from the premises will not be distinguishable above background levels 1 metre from the façade of the nearest residential property.
Steps taken in order to promote the four Licensing objectives
1. CCTV system installed and maintained to the satisfaction of the Police and Licensing Authority.
2. No persons will be permitted to take open containers or alcohol or soft drinks from the premises.
3. All bottles and/or glasses will be removed from the public areas within the premises as soon as is practicable after they are finished with or empty.
4. Any persons engaging in disorderly behaviour or criminal activity on the premises will either be warned and/or ejected from the premises at the discretion of the management.
5. Any incidents of criminal activity on the premises, which comes to the attention of the management, will be reported to the police promptly.
6. Fire safety and other safety measures which require the premises to be maintained in good order, and the adequacy of these measures, will be determined on a regular basis by carrying out the appropriate risk assessments as required in accordance with the Fire Precautions (Work Place) Regulations and/or any other applicable legislation which may from time to time be in force.
7. Give consideration to setting a capacity limit if so advised by the Police, Fire Authority or Local Licensing Authority.
8. Cooperate fully with the Licensing Authority, Police and Fire Authority in relation to the safety of all persons entering and leaving the premises.
9. Noise and/or vibration from the premises will not be excessive so as to give rise to a reasonable complaint.
10. The management will control the sound levels of all music and entertainment at the premises to ensure such activities shall not be intrusive or cause a nuisance to any neighbouring noise sensitive premises.
11. The premises will be adequately vented to prevent nuisance from noxious smells.
12. A proof of age policy agreed by the Police and Local Authority will be enforced to ensure all statutory obligations in this regard are met.
