ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A. Conditions that have been agreed with The Environmental Health Authority
Public Safety
1. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure their safety.
2. Where temporary electrical equipment is to be used, i.e. equipment brought in by entertainers etc, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker will operate at a current not exceeding 30 mA and should comply with BS 4293. The device will be tested monthly and tests will be recorded.
3. An air management system is in place and will be used when all windows and doors are closed, i.e. during entertainment, etc.
Public Nuisance
1. The use of outside area will not commence before the start of opening hours and will cease at dusk or at 21.00 hours, whichever is earlier.
2. The emergency exits are well fitted and are kept shut during opening hours.
3. Doors and windows will be kept shut during entertainment.
4. Staff will check prior to entertainment, and periodically during the entertainment, that all windows and doors are shut.
5. A senior member of staff (manager) will assess the impact of any noisy
activities on neighbouring premises at the start of the activity/entertainment and periodically throughout the activity/ entertainment and take action to reduce noise levels if they are found to be excessive/ distinguishable above background levels at the nearest residential property
6. Management will control the sound levels of the music/ entertainment.
Before 23.00hrs
To prevent entertainment being intrusive, noise emanating from the premises will not be clearly audible 1 metre from the facade of the nearest residential property.
Between 23.00hrs & 00.00hrs
To prevent entertainment being intrusive, noise emanating from the premises will not be clearly distinguishable above other noise 1 metre from the facade of the nearest residential property.
Between 00.00hrs and closing
1. Noise emanating from the premises will not be distinguishable above back ground levels 1 metre from the facade of the nearest residential property.
2. Provision of mechanical ventilation and the air management system will not allow noise breakout from the premises or cause a nuisance by its operation.
3. Suitable signage will be provided at the exit to request the co-operation of patrons to make as little noise as possible when leaving the premises.
4. A member of staff will be positioned at exits particularly at closing times.
B. Conditions that have been agreed with The Licensing Police Authority
CCTV
1. CCTV system working and recording good quality images.
2. The recorded image to be kept for a period of 28days.
3. The Police Licensing department will be informed if the CCTV system is not working properly.
4. A notice will be displayed at the entrance advising CCTV is in operation.
5. Lighting within the premise will not undermine the quality of the recorded image.
Steps taken to promote the four Licensing objectives
General
1. Staff banned from drinking on duty.
2. Records maintained of any material incidents within or in immediate vicinity of premises
3. Drugs warning notices on display.
4. Zero tolerance to drugs use and dealing
5. Policy of banning customers for misbehavior within or in vicinity of premises where deemed necessary and appropriate.
6. Availability of soft drinks, non-alcoholic and/or low alcohol beverages at all times.
7. Food Available
(b) The prevention of crime and disorder
1. Specific staff training and supervision in assessment of customer consumption and condition.
2. No cheap drinks, promotions, cut-price drinks, "package deals" other than on isolated and special occasion.
3. No cheap alcoholic drinks promotions cut-price drinks, "package deals".
4. No drinks hoarding.
5. Pro-active policy against "binge" drinking.
6. Zero tolerance to offensive conduct.
7.Toughened glassware for draught products.
8. Regular glass collection.
(c) Public safety
1. Regular dedicated cleaning of premises.
(d) The prevention of public nuisance
1. Advisory notices re. noise on leaving premises.
2. Freephone or similar taxi facility.
3. Nominated staff to deal with complaints from neighbours
(e) Protection of children from harm
1. No entry to anyone under 18 unless accompanied by an adult.
2. Warning notices in place.
3. Full training for staff in law specifically relating to minors and alcohol and specific photo i/d proof of age requirements.
