ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Supply of alcohol
1. a) No intoxicating liquor shall be supplied otherwise than to:
b) A member of the Club known as Embassy Social & Snooker Club who has been a member for at least twenty four hours or whose nomination or application for membership was made at least twenty four hours before their admission.
c) A bona fide guest of such a member.
d) Members of organised pool, snooker, darts and euchre teams attending the premises for organised matches in accordance with Rule 27.
e) To persons attending a bona fide private function admission to which shall be by personal invitation or ticket only.
2.No intoxicating liquor shall be supplied for consumption off the premises except to a Member in person.
3. There shall be rules of the Club for the election of Members
4. A list of names and addresses of all members shall be kept on the premises.
5. Any alteration in the rules providing for the admission of persons other than Members shall be notified to the licensing authority.
The authorised hours for the sale of alcohol do not prohibit:
1. during the first twenty minutes after the end of authorised hours the consumption of the alcohol on the premises;
2. during the first twenty minutes after the end of authorised hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
3. during the first thirty minutes after the end of authorised hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
4. consumption of the alcohol on the premises or the sale or supply of alcohol to any person residing in the licensed premises;
5. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
6. the sale of alcohol to a trader or club for the purposes of the trade or club;
7. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
8. the taking of alcohol from the premises by a person residing there; or
9. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
10. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
11. the sale or supply of alcohol from the end of authorised hours on New Years Eve to the start of authorised hours on New Years day
1. All staff engaged in licensable activity at the premises will receive training and information in relation to the following:
i. The Challenge 25 scheme in operation at the premises, including the forms of identification that are acceptable.
ii. The hours and activities permitted by the premises license issued under the Licensing Act 2003 and conditions attached to the licence.
iii. How to complete and maintain the refusal register in operation at the premises.
(In relation to the sale of alcohol).
iv. Recognising the signs of drunkenness.
v. The operating procedures for refusing service to any person who is drunk, under-age or appears to be under-age, or appears to be making a proxy purchase.
vi. Action to be taken in the event of an emergency, including reporting an incident to the emergency services.
2. Training shall be recorded in documentary form and shall be regularly refreshed at no greater than 6-month intervals. Training records shall be made available for inspection and copying at reasonable times upon request of an authorised officer of a responsible authority.
Training records will be retained for at least 12 months.
3. There shall be a personal licence holder on duty on the premises at all times when the premises are authorised to sell alcohol.
4. An incident book shall be maintained to record any activity of a violent, criminal, or anti-social nature. The record will contain the time and date, the nature of the incident, the people involved, the action taken and details of the person responsible for the management of the premises at the time of the incident.
5. The Premises Licence Holder or Designated Premises Supervisor shall ensure a sales refusal register is maintained to include details of all alcohol sales refused and the reason for refusal. The refusals register should be made available to an authorised enforcement officer on request.
6. There shall be no customer entry/re-entry after 00:30 hours, save for existing customers who have temporarily left the premises to smoke.
7. No open vessels containing alcohol shall be removed from the premises
8. The Premises Licence Holder will ensure that a CCTV system is fully compliant with the guidance contained in the Information Commissioner’s Office (ICO) guidance document (www.informationcommissioner.gov.uk) regarding installation of CCTV is provided at the premises.
9. Images shall be retained for a minimum of 28 days.
10. The CCTV system shall be capable of downloading images to a recognizable viewable format.
11. At all times the premises are open for business a member of staff shall be present who is capable of operating the CCTV system and downloading images at the request of police or other authorised officer.
12. The DPS and/or the Premises Licence Holder will be responsible for conducting dynamic risk assessments for the requirement of additional door staff especially during busy periods, public holidays, or any other events such as sporting events.
13. When required the following details for each door supervisor will be contemporaneously entered into a register kept for that purpose:
I. Full name
II. SIA Licence/badge number, and registration number of any accreditation scheme recognised by the Licensing Authority (including expiry date of that registration or accreditation)
III. The date and time they began their duty
IV. The date and time they completed their duty
V. The full details of any agency through which they have been allocated to work at the premises if appropriate
14. The register shall be available for inspection and copying at all reasonable times by an authorised officer of a responsible authority.
15. The register shall be kept at the premises at all times and be so maintained as to enable an authorised officer to establish the particulars of all door supervisors engaged at the premises during the period of not less than 12 months prior to the request.
16. There will be in place a written age verification policy in relation to the sale or supply of alcohol, which will specify a Challenge 25 proof of age requirement. This means that staff working at the premises must ask individuals who appear to be under 25 years of age, attempting to purchase alcohol, to produce identification. The only acceptable identification documents will be:
- A photo driving licence
- A passport
- An identification card carrying the PASS hologram
Unless such identification is produced the sale of alcohol must be refused
Prevention of Pubic Nuisance
1. Between 23:00 and 08:00 there will be total sound containment within the premises.
2. The pavement at the front door of the premises must be kept clean. This area must be swept and cleared of any litter at the start and end of trading.
3. During opening hours suitable provision will be provided at the front door of the premises for the collection of smoking related litter.
Conditions agreed with the Environmental Health Officer
The Premises Licence Holder or nominated person will assess the impact of any noisy activities on neighbouring premises at the start of regulated entertainment and periodically throughout regulated entertainment and take action to reduce noise levels if they are found to be heard above bacjground levels at the nrearest residential property.
The Premise Licence Holder or nominated person shall be available at all times during regulated entertainment and is responsible for cooperating and liaising with any relevant responsible authority.
All windows and doors shall be kept shut during regulated entertainment.
The Premise Licence Holder or nominated person shall ensure that exits are manned at closing time to ensure that patrons leave the area quickly and and quietly as possible.
