ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Conditions agreed with Environmental Health Authority
Public Nuisance
1. Between 23:00 hrs & 00:00 hrs
To prevent entertainment being intrusive, noise emanating from the premises will not be clearly distinguishable above other noise 1 metre from the façade of the nearest residential property.
2. Between 00:00 hrs and 02:00 hrs
Noise emanating from the premises will not be distinguishable above background levels 1 metre from the façade of the nearest residential property.
3. After 02:00 hrs until closing
Total sound containment within the premises.
B Steps taken in order to promote the four Licensing objectives
Public Safety
1. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure their safety.
2. Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker should operate at a current not exceeding 30 mA and should comply with BS 4293. The device must be tested quarterly and tests will be recorded.
3. The Gas System including appliances will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
4. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
5. Provision for disabled patrons will be provided where it is reasonably practicable for disabled access to the premises and sanitary facilities.
6. The sanitary accommodation consists of:
First Floor:-
Male WC’s - 1 Female WC’s - 1
Male urinals - 1 WHB’s -1
WHB’s - 1
Also one accessible toilet and hand basin for use by all (including disabled access)
Second Floor:-
One accessible toilet and hand basin for use by all (including disabled access). The location of the facilities are indicated on the attached plan.
7. All sanitary accommodation will be maintained in good working order.
8. Suitable and sufficient lighting will be provided to the toilets.
9. Provision will be made for the collection and disposal of sanitary towels.
10. Suitable and sufficient ventilation will be provided to the toilets.
11. First aid provision will be available for the use of patrons.
12. CCTV will be provided to enhance the safety of patrons and staff where deemed appropriate.
13. Facilities for depositing litter and the collection of litter generated by patrons will be available and maintained.
The Prevention of Public Nuisance
1. The first and second floors are to be sound proofed.
2. Doors and windows will be kept shut during entertainment
3. Suitable signage will be positioned at exits to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises.
4. Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly.
5. An announcement will be made prior to closing requesting patrons co-operation in leaving the premises and vicinity as quietly and quickly as possible.
6. Entrances are provided with lobbies with automatic door-closers. The lobbies are in use throughout the time of entertainment.
7. The emergency exits are well fitted and are kept shut during opening hours.
8. A specific taxi operator has been nominated for staff and customers use. The company’s telephone number is advertised to customers. The operator, and all drivers, are aware that they should arrive and depart as quietly as possible, should not sound vehicle horns as a signal of their arrival or leave engines idling unnecessarily. In addition, staff will leave as quietly as possible, particularly at night and early in the morning.
9. Staff will check prior to entertainment and periodically during the entertainment that all windows and doors are shut.
10. Management will control the sound levels of the music/entertainment
11. Provision of mechanical ventilation and air conditioning systems will not allow noise breakout from the premises or cause a nuisance by its operation.
12. The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night and during the early morning, when the noise generated could cause a nuisance particularly outside buildings.
13. Bottle skips and bins containing cans or bottles will not be emptied outside after 11.00pm but will be dealt with the next day during normal office hours.
14. Ventilation equipment will be regularly cleaned and maintained to control the levels of odour generated by the premises.
15 All the rubbish produced by the premises will be stored securely in a designated area or in a bin with a tight fitting lid.
16. All commercial waste collection will be arranged for after 8am.
