ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Supply of alcohol
Any existing conditions attached to existing justices licence
The authorised hours for the sale of alcohol do not prohibit:
1. during the first twenty minutes after the end of authorised hours the consumption of the alcohol on the premises;
2. during the first twenty minutes after the end of authorised hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
3. during the first thirty minutes after the end of authorised hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
4. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
5. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
6. the sale of alcohol to a trader or club for the purposes of the trade or club;
7. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
8. the taking of alcohol from the premises by a person residing there; or
9. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
1. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
B Steps that have been taken to promote the four Licensing Objectives
Prevention of Crime and Disorder
Capacity Limit
The maximum number of persons allowed on the premises will be 150 within the licensed area of the premises, that The Alpine Lodge
There shall be displayed at the entrance to the premises a sign, which is clearly visible to members of the public visiting those premises containing details of the trading hours under the Premises Licence, the licensable activities permitted on those premises and any maximum occupancy level set for the premises
Proof of Age Scheme
There is in place a written admissions policy to prevent the sale or supply of alcohol to persons under the age of 18 years of age. This policy requires that any person who appears to be under the age of 18 years to produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS) a citizen card supported by the home office, a photo driving licence, a passport or office HM forces or EU ID card bearing photo and date of birth
A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age
Crime Prevention Notices
These will be displayed and used to warn customers not to leave their bags unattended and to guard their property
Drinking Games and Promotions
Drinking games will not be permitted in the bar or restaurant area within Centre. The centre reserves the right to operate promotional events on a very limited basis for a very restricted period. The Centre will not operate a ‘Happy Hour’ or similar promotions
Public Safety
Fire Safety
The centre operates with a proven fire prevention policy, which is supported by a fire detection system and a full range of fire fighting equipment. Records of all alarm checks and other statutory requirements are available for inspection at all times
The centre provides a maintained emergency lighting system and clear illuminated means of escape, which are clearly identified with the appropriate signage
Printed notices shall be prominently displayed in the premises detailing the essential steps that must be taken if a fire is discovered or the fire alarm goes off or other emergency arises and how to call the Fire Service
All exits doors and gates from premises or enclosure(s) surrounding it shall be capable of being opened by any person without the use of a key, card, code or other similar means and be kept free from all fastening devices when the premises are open to the public
A person who is nominated for the purpose of taking control in the event of a fire, fire alarm, emergency or event which may effect the safety of persons attending the premises shall be on and in charge of the premises at all times, when any licensable activity is being provided
That person shall be responsible for calling the Fire Service in the event of any fire and that person shall also be responsible for meeting the Fire Service and advising them of the location of the fire.
All members of staff are fully trained in Fire Health and Safety matters on a bi-annual basis and training records signed by each member of staff. In addition to the classroom training the centre arranges a full evacuation of the building twice a year and evacuation times are recorded
A Process is in place and is trained to the appropriate staff, Duty Managers, for the safe and efficient evacuation of disabled people from licensed areas. The Centre pays proper regard to the requirements of the Disability Discrimination Act
First Aid
First aid equipment is available in all areas of the Centre including licensed areas. First aiders are on duty at all times and the Centre ensures that its first aiders have an appropriate four-day qualification
The Prevention of Public Nuisance
Hours of Opening
The licensed premises or the parts of the licensed premises edged in red on the attached plan of the premises may be open to the public between the hours of:
09.00hrs - 01.30hrs Monday to Sunday
Noise
No nuisance shall be caused by noise coming from the premises or by vibration transmitted through the structure of the premises
Notices will be displayed at all exits from the premises in a place where they can be seen and easily read by the public, requiring customers to leave the premises and the area quietly
All deliveries are planned during daylight hours to avoid disturbance to local residents
Offensive Smells
There shall be no emission from the premises of any offensive smells, which are likely to cause a nuisance
Waste Materials
There shall be provided at the premises containers for the storage and disposal of waste foods and other refuse from the premises. Those containers shall be constructed, maintained and located so that access to them by vermin and unauthorised persons is prevented and arrangements shall be made for the regular lawful disposal of their contents
Protection of Children from Harm
Age Restrictions
The Centre will admit children onto the licensed premises in designated areas to enable them to attend wedding receptions, birthday parties or private functions in the Centres restaurant. Children will be permitted to dine in the restaurant when accompanied by an adult and subject to the licensing requirements. The Centre does not offer any alcohol for sale for consumption off the premises
The Centre will only permit children between the ages of 16-17 to consume limited amounts of beer, wine or cider providing they are with and adult over the age of 18 and eating a table meal. These young people are to remain under the supervision of an adult at all times
Apart from the disclosure above, the Centre will prevent the risk of children being exposed to those dangers listed under section 5.9 of the Licensing Policy by operating the tight controls currently in place and the continuous training of new members of staff
The Portman Group Code of Practice on the naming, packaging and promotion of alcoholic drinks
The Premises Licence holder and the designated premises supervisor shall at all times comply with The Portman Group Code of Practice and with the requirements of recommendations from any Portman Group Retailer Alert Bulletin
