ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Supply of alcohol
The authorised hours for the sale of alcohol do not prohibit:
1. during the first twenty minutes after the end of authorised hours the consumption of the alcohol on the premises;
2. during the first thirty minutes after the end of authorised hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
3. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
4. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
5. the sale of alcohol to a trader or club for the purposes of the trade or club;
6. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
7. the taking of alcohol from the premises by a person residing there; or
8. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
9. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Prevention of Crime & Disorder
1. All staff engaged in licensable activity at the premises will receive training and in relation to the following :-
i. Challenge 25 scheme shall be in operation at the premises.
ii. The hours and activities permitted by the premises license issued under the Licensing Act 2003.
iii. The completion and maintenance of the customer refusal register in operation at the premises in relation to the sale of alcohol.
iv. Recognising the signs of intoxication.
v. The procedure for refusing service to any person who is drunk, under-age / appears to be under-age or appears to be making a proxy purchase on behalf of another who is underage.
2. Training shall be recorded in electronic or documentary form and shall be provided at least every 6-months. Training records shall be made available for inspection and copying upon the reasonable request of an authorised officer of a responsible authority. Training records will be retained for at least 12 months.
3. An incident book shall be maintained to record any activity of a violent, criminal, or antisocial nature. The record will contain the date, time, nature of the incident, the names of the people involved (if known) and the action taken.
4. The Designated Premises Supervisor shall ensure a sales refusal register is maintained to include details of all alcohol sales refused and the reason for refusal. The refusals register should be made available to an authorized enforcement officer upon request.
5. No open vessels containing alcohol shall be removed from the premises
6. The premises licence holder must remain vigilant against any nuisance being caused.
7. The Premises Licence Holder will ensure that the operating CCTV system at the premises is fully compliant with the guidance contained in the Information Commissioner’s Office and shall be retained for a minimum of 28 days.
8. CCTV images or videos shall be provided to the police or other authorised officer within 24 hours of any request.
9. At all times the premises are open for business a member of staff shall be present who is capable of operating the CCTV system and downloading images at the request of police or other authorised officer
10. All staff shall receive appropriate training prior to undertaking the sale of alcohol. Training records shall be documented and kept on the premises available for inspection to an authorised officer of a responsible authority upon request. Training records must be kept for a minimum period of 3 years.
11. There will be an age verification policy in relation to the sale or supply of alcohol. In accordance with the Challenge 25 Scheme.
General, Public Nuisance & Public Safety
1. Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker should operate at a current not exceeding 30mA and should comply with BS 4293. The device must be tested monthly and test will be recorded.
2. The gas system including appliances will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained
3. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies
4. The sanitary accommodation consists of:
Male WC’s - 1 Female WC’s - 2
Male Urinal - 3 WHB’s - 1
WHB’s - 1
5. All sanitary accommodation will be maintained in good working order. Suitable and sufficient lighting will be provided to the toilets
6. Provision will be made for the collection and disposal of sanitary towels
7. First aid provision will be available for the use of patrons
8. Regular glass and bottle collection will be undertaken throughout opening hours
9. Suitable signage will be positioned at exits to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises
10. Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly
11. Entrances are provided with lobbies, with automatic door-closers. The lobbies are in use throughout the time of entertainment
12. A specific taxi operator has been nominated for staff and customers use. The company’s telephone number is advertised to customers. The operator and all drivers, are aware that they should arrive and depart as quietly as possible, should not sound vehicle horns as a signal of their arrival or leave engines idling unnecessarily. In addition, staff will leave as quietly as possible. Particularly at night and early in the morning.
13. Management will control the sound levels of the music/entertainment
14. The delivery of goods is restricted to the normal working day
15. The delivery of goods will be limited in number and/or frequency
16. The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night and during the early morning when the noise generated could cause a nuisance particularly outside buildings
17. Bottles skips and bins containing cans or bottles will not be emptied outside after 23.00hrs but will be dealt with the next day during normal office hours
18. The movement of bins and rubbish outside the premises will be kept to a minimum after 23.00hrs
