ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Supply of alcohol
Any existing conditions attached to existing justices licence
The authorised hours for the sale of alcohol do not prohibit:
1. during the first twenty minutes after the end of authorised hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
2. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
3. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
4. the sale of alcohol to a trader or club for the purposes of the trade or club;
5. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
6. the taking of alcohol from the premises by a person residing there; or
7. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
8. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
B Conditions that have been agreed with the Environmental Health Authority
1. Live Music will cease at 23.00 hours.
2. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring premises at the start of the activity/entertainment and periodically throughout the activity/entertainment and take all reasonably action to reduce noise levels if they are found to be excessive/distinguishable above background levels at the nearest residential property.
3. Management will control the sound levels of the music/entertainment played from the Premises.
4. Between 00:00 hrs and 01:00 hrs
To prevent entertainment being intrusive, noise emanating from the Premises will not be clearly audible 1 metre from the façade of the nearest residential property.
C Steps taken to promote the four licensing objectives
1. Participation in the pub/club watch scheme
2. Lighting outside premises
3. Zero tolerance to drugs. Signs to this effect will be displayed in the premises
4. Regular removal of all glasses and bottles
5. Deliveries are only made during daytime hours
6. Children are not permitted on the premises after 21.00hrs
7. The premises will close to the public 30 minutes after the latest licensable activity ceases.
7. CCTV to be maintained and operated to the reasonable satisfaction of the Chief of Police
8. CCTV Recordings will be maintained for at least 28 days.
9. If the CCTV is inoperative, the Police and Licensing Authority will be informed as soon as reasonably possible and immediate steps taken to put the equipment back into operation.
10. A notice is to be displayed upon the premises advising patrons and staff that CCTV is in operation
11. All external windows and doors fronting onto Gilwell Street (Except in the case of an emergency and/or for access/egress) shall be kept closed whenever Live or Recorded music (Other than background/incidental music) is played from the premises.
12. The Licence holder shall maintain a log of complaints for the premises received from Local Residents together with a log of action (if any) undertaken. This Log shall upon request, be made available for inspection by the police and/or Licensing Authority.
13. Clear and legible notices shall be strategically and prominently placed upon the premises requesting customers to respect the needs of local residents and to leave the premises quietly.
14. The placing of all non food waste/refuse, such as bottles, into receptacles outside the premises shall not take place between the hours of 23:00 and 08:00.
15. The Duke box shall be turned down to background levels from 01:00
16. The evidence of age shall be requested from any person appearing to those selling alcohol to be under the age of 18 and who is attempting to purchase alcohol.
