Additional Conditions

• ANNEX 1 - MANDATORY CONDITIONS

   

  (1) The first condition is that no supply of alcohol may be made under the premises licence: -

  (a) At a time when there is no designated premises supervisor in respect of the premises licence, or

  (b) At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Door supervision

   

  (1) Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each such individual must be licensed by the Security Industry Authority.

   

  (2) But nothing in subsection (1) requires such a condition to be imposed-

  (a) in respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c.12) (premises with premises licences authorising plays or films), or

  (b) in respect of premises in relation to-

  (i) any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or

  (ii) any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).

   

  (3) For the purposes of this section-

  (a) "security activity" means an activity to which paragraph 2(1)(a) of that Schedule applies, and

  (b) paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE 

   

  Steps taken in order to promote the four licensing objectives

   

  The Prevention of Crime and Disorder
   

  1.              Door Supervisors will be employed any day of the week the premises are open and will consist of at least 2 door supervisors for the first 100 patrons and 1 for every 100 patrons thereafter.

   

  2.              A separate register will be maintained recording the details of door supervisors working. It will include Date, name, SIA registration number, expiry date of licence, the time duty commenced and time duty ceased.

   

  3.              A daily incident logbook detailing all incidents of note at the premises or in the immediate vicinity e.g. slips, accidents, entry refusals and incidents of disorder etc.  The log will detail the date, time, type of incident, brief circumstances, action taken and person dealing.  The logbook will be made available for up to six months Police or any other responsible authority for inspection, if required.  All relevant incidents will be reported to the police at the earliest opportunity

  4.              Staff are banned from drinking on duty.

   

  5.              No irresponsible drinks promotions or all inclusive offers.

   

  6.              Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18.  The following are the only forms of identification acceptable:

  7.              Notices obtained from Police publicising the Challenge 21 initiative shall be clearly displayed at the entrance to the premises and behind the bar area at all times.

   

  8.              The DPS will ensure regular and documented training of staff in relation to the prevention of under age sales.

   

  9.              No open bottles or other vessels will be permitted to be taken from the premises.

  Public Safety

  1.              Clickers will be used to manage the capacity as determined with the Devon and Somerset fire service.

   

  2.              CCTV to be installed to comply with the ‘UK Police Requirements for Digital CCTV Systems’ and will cover all areas to which the public have access

   

  3.              CCTV cameras to be kept clean and maintained at all time.

   

  4.              Images will be retained for a minimum of 31days.

   

  5.              The system will have the capability of downloading the images to a recognised format.

  6.              A register will be kept detailing all requests by Police for CCTV images. This will include time and date of request, time, date and location of incident, time and date of hand on to Police.

   

  7.              During trading hours, members of staff will be present who are trained to view and download images from CCTV at request of Police.

   

  8.              The Police Licensing Department will be informed if the CCTV system is not working.

   

  9.              Regular glass and bottle collection will be undertaken throughout opening hours.

   

  10. A means of addressing patrons during operating hours, which can be heard above entertainment or a means of interrupting the entertainment to make important safety announcements will be available.

   

  The Prevention of Public Nuisance
  
  1. Management will control the sound levels of the music/entertainment.

  
  2. All rubbish produced by the premises will be stored securely in a designated area or in a bin with a tight fitting lid.
  
  3. Doors and windows will be kept shut during entertainment.

  
  4. Suitable signage at the exit to request the co-operation of patrons to make as little noise as possible when leaving the premises.

  
  5. Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly.

  
  6. A member of staff will be positioned at exits particularly at closing times.

  
  7. Staff will check prior to entertainment, and periodically during the entertainment, that all windows and doors are shut.

  
  8. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring premises at the start of the activity/entertainment and periodically throughout the activity/entertainment and take action to reduce noise levels if they are found to be excessive/distinguishable above background levels at the nearest residential property.
  
  Between 00.00hrs and 02.00hrs
  
  9. Noise emanating from the premises will not be distinguishable above background levels one metre from the façade of the nearest residential property.
  
  After 02.00hrs until closing
  
  10. Total sound containment within the premises.

  
  11. The handling of beer kegs bottles and other similar items will not take place in the late evening, at night and during the early morning, when the noise generated could cause a nuisance particularly outside buildings.
