ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Supply of alcohol
Any existing conditions attached to existing justices licence
The authorised hours for the sale of alcohol do not prohibit:
1. during the first twenty minutes after the end of authorised hours the consumption of the alcohol on the premises;
2. during the first twenty minutes after the end of authorised hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
3. during the first thirty minutes after the end of authorised hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
4. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
5. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
6. the sale of alcohol to a trader or club for the purposes of the trade or club;
7. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
8. the taking of alcohol from the premises by a person residing there; or
9. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
10 he supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
B Steps that have been taken to promote the four licensing objectives
The Prevention of Crime and Disorder
1. Staff will be suitably trained to prevent the sale of alcohol to under 18 years olds
Public Safety
2. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure their safety
3. Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker should operate at a current not exceeding 30mA and should comply with BS 4293. The device must be tested quarterly and tests will be recorded.
4. The Gas System including appliances will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained
5. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies
6. The sanitary accommodation consists of:
Male WC’s - 1 Female WC’s - 1
Male urinals - 2 WHB’s - 1
WHB’s - 1
7. The sanitary accommodation will be maintained in good working order
8. Suitable and sufficient lighting will be provided to the toilets
9. Provision will be made for the collection and disposal of sanitary towels
10. Suitable and sufficient ventilation will be provided to the toilets
11. First aid provision will be available for the use of patrons
12. Regular glass and bottle collection will be undertaken throughout opening hours
The Prevention of Public Nuisance
1. Patrons will be asked not to stand around talking in the street outside the premises and asked to leave the vicinity quickly and quietly
2. A specific taxi operator has been nominated for staff and customers use. The company’s telephone number is advertised to customers. The operator, and all drivers are aware that they should arrive and depart as quietly as possible, should not sound vehicle horns as a signal of their arrival or leave engines idling unnecessarily. In addition, staff will leave as quietly as possible, particularly at night and early in the morning.
3. A senior member if staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.
4. Management will control the sound levels of the music/entertainment
5. The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night and during the early morning, when the noise generated could cause a nuisance particularly outside buildings
C Conditions agreed with The Environmental Health Representative
Public Safety
An air management system within the premises will be used during entertainment, as there will be insufficient ventilation when all windows and doors are closed, to prevent noise break out. Details of the system will be forwarded to the Environment Regulation Services for comment
Prevention of Public Nuisance
1. Doors and windows will be kept shut during entertainment
2. Suitable signage at the exit to request the co-operation of patrons to make as little noise as possible when leaving premises
3. A member of staff will be positioned at exits particularly at closing times
4. Staff will check prior to entertainment, and periodically during the entertainment, that all windows and doors are shut
Between 23.0hrs and 00.00hrs
1. To prevent entertainment being intrusive, noise emanating from the premises will not be clearly distinguishable above other noise one metre from the façade of the nearest residential property.
Between 00.00hrs and 02.00hrs
2. Noise emanating from the premises will not be distinguishable above back ground levels one metre from the façade of the nearest residential property
After 02.00hrs until closing
3. Total sound containment within the premises
