Additional Conditions

• ANNEX 1 - MANDATORY CONDITIONS

   

  (1) The first condition is that no supply of alcohol may be made under the premises licence: -

  (a) At a time when there is no designated premises supervisor in respect of the premises licence, or

  (b) At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  Exhibition of films

   

  (1) Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.

   

  (2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  (3) Where-

                (a) the film classification body is not specified in the licence, or

  (b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,

  admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  (4) In this section-

                "children" means persons aged under 18; and

  "film classification body" means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Steps taken in order to promote the four Licensing objectives

   

  1.              Staff will be trained on the requirements of the Licensing Act 2003 when they are recruited.

  2.              Opened bottles or drinks containers will not be allowed to be taken from the premises and empty vessels will be removed as soon as they are finished with by regular collections in the trading area.

  3.              The fire safety measures with which the premises are provided will be maintained in good working order and their adequacy will be determined on a regular basis by the carrying out of a risk assessment as required by and in accordance with the Fire Precautions (Workplace) regulations.

  4.              Recorded music volume will be reduced to background level during the wind down period to create a mood change.

  5.              A notice requesting customers leave in a quiet and orderly fashion at the end of trading time will be placed prominently near to exits.

  6.              Photographic proof of age will be required to be shown by anyone seeking to purchase alcohol who appears may be under 18 years of age.

   

• Annex 3 - Conditions attached after a hearing by the licensing authority

   

  (a)              Proper signage to be displayed in the car park advising people of responsibility to ensure they behave in a proper manner so not to cause disturbance to people living nearby.

  (b)              Doors and windows will be kept shut during entertainment.

  (c)              Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly.

  (d)              An announcement will be made prior to closing requesting patrons co-operation in leaving the premises and vicinity as quietly and quickly as possible.

  (e)              Staff will check prior to entertainment, and periodically during the entertainment, that all windows and doors are shut.

  (f)              A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.

  (g)              Management will control the sound levels of the music/entertainment.

                Between 23:00 and 00:30

  (h)              To prevent entertainment being intrusive, noise emanating from the premises will not be clearly audible 1 metre from the façade of the nearest residential property.

  (i)              The use of outside drinking areas will not commence before the start of normal trading hours and will cease 23:00 hours.

  (j)              Staff will monitor the use of the car park to ensure patrons do not congregate in this area and cause annoyance.
