ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
1. All staff shall be fully trained to perform their role. They will also be trained in the contents of the premises licence including times of operation, licensable activities and all conditions.
2. Training shall be recorded in documentary form and those records will be available for inspection at the request at all reasonable times by an authorised officer from a relevant responsible authority. The records will be retained for at least 12months.
3. In the absence of the DPS there must be a personal licence holder the duty staff member shall be the holder of a personal licence obtained from a nationally recognised body.
4. An incident book shall be maintained to record any activity of a violent, criminal or anti-social nature. The record will contain the time and date, the nature of the incident, the people involved, the action taken and details of the person responsible for the management of the premises at the time of the incident. The incident book shall be available for inspection at all reasonable times by an authorised officer of the relevant responsible authority. The records will be retained for at least 12 months.
5. All staff shall be suitably trained in the operating procedures for refusing service to any person who is drunk or is underage or appears to be under-age. Training shall be recorded in documentary form and those records will be available for inspection at the request at all reasonable times by an authorised officer from a relevant responsible authority. The records will be retained for at least 12 months.
6. The Premises Licence Holder or nominated person shall ensure that a clearly visible notice is displayed advising those attending, that the Police will be informed if anyone is found in possession of controlled substances or weapons.
7. Any door staff employed shall be trained in the requirements of the Challenge 25 policies, the identification & recognition of drunks and the correct procedures to be followed when refusing service. Training shall be recorded in documentary form and those records will be available for inspection at the request at all reasonable times by an authorised officer from a relevant responsible authority.
8. The Premises Licence Holder and/or Designated Premises Supervisor shall not allow any drinking vessel, glass or bottle to be taken from the site.
9. All Door Staff engaged in searching persons (as a condition of entry) shall be fully trained in the use of their powers to do so. Training shall be recorded in documentary form and those records will be available for inspection at the request at all
reasonable times by an authorised officer from a relevant responsible authority. The records will be retained for at least 12months.
10. The Premises Licence Holder and/or Designated Premises Supervisor shall ensure that the following details for each door supervisor are contemporaneously entered into a bound register kept for that purpose:
(i) Full name,
(ii) SIA Certificate number and or badge number, or registration number of any accreditation scheme recognised by the
Licensing Authority (including expiry date of that registration or accreditation),
(iii) The time they began their duty
(iv) The time they completed their duty.
(v) The full details of any agency through which they have been allocated to work at the premises if appropriate
The register shall be available for inspection at all reasonable times to an authorised officer of the Licensing Authority or a police constable.
This register is to be kept at the premises at all times and shall be so maintained as to enable an authorised officer to establish the particulars of all door staff engaged at the premises during the period of not less than 12 months prior to the request.
11. The Premises Licence Holder will ensure that a CCTV system is fully compliant with the guidance contained in the Information Commissioner's Office (ICO) guidance document (www.informationcommissioner.gov.uk) regarding installation of CCTV is provided at the premises.
12. The CCTV equipment shall be maintained in good working order and continually record when licensable activity takes place and for a period of two hours afterwards.
13. The CCTV system shall cover all areas of the premises to which the public have access including any outside areas.
14. Images shall be retained for a minimum of 28 days
15. The CCTV system shall be capable of downloading images to a recognizable viewable format.
16. At all times the premises are open for business a member of staff shall be present who is capable of operating the CCTV system.
17. The CCTV system shall be capable of obtaining clear facial recognition images and a clear head and shoulders image of every person entering or leaving the premises.
18. If the CCTV equipment (Including any mobile units in use at the premises) breaks down the Premises Licence Holder shall ensure the Designated Premises Supervisor, or in his/her absence other responsible person, informs the Licensing Authority and the Police as soon as is reasonably practicable. This information shall be contemporaneously recorded in an incident report register and shall include the time, date and means this was done and to whom the information was reported. Equipment failures shall be repaired or replaced as soon as is reasonably practicable and without undue delay.
The Licensing Authority and the Police shall be informed when faults are rectified.
The prevention of crime and disorder
The Premises Licence Holder and/or Designated Premises Supervisor shall conduct a written risk assessment on the requirement of SIA registered door staff. The risk assessment will include the number of door staff required and will be available on request to a responsible authority.
There will be in place a written age verification policy in relation to the sale or supply of alcohol, which will specify a Challenge 25 proof of age requirement. This means that staff working at the premises must ask individuals who appear to be under 25 years of age, attempting to purchase alcohol, to produce identification. The only acceptable identification documents will be:
- A photo driving licence
- A passport
- An identification card carrying the PASS hologram
Unless such identification is produced the sale of alcohol must be refused.
For Boxing Events
The Premises licence Holder must comply with an Event Management Plan submitted to the Licensing Authority and Police Licensing, no changes will be made to the Event Management Plan without the prior written consent of the Licensing Authority or the Police. The Plan must set out (but is not limited to):
1. How fighters will be matched
2. The measures that will be in place to ensure the safety and welfare of competitors; including medical facilities and qualified staff provision
3. Layout of the venue
Competition rules
4. Referee details including qualifications.
5. Alcohol Management Plan (if alcohol is available)
6. Safeguarding of Under 18’s
CCTV will be installed to monitor entrances, exits, and other parts of the premises in order to address the prevention of crime objective.
A clear and legible notice outside the premises indicating the normal hours under the terms of the premises licence during which licensable activities are permitted.
In external areas, drinks are only available for consumption from plastic receptacles.
Where glass bottles are used, they will be retained or disposed of on the premises.
No customers will be admitted or permitted to leave when carrying opened or sealed glass receptacles.
The premises will ensure the disposal of waste on the frontage of the premises.
Public safety
Escape routes and exits, including external exits are maintained to ensure that they are not obstructed, in good order with non-slippery surfaces, free of trip hazards and clearly identified and a record is made of these checks.
Internal gangways will be kept clear and unobstructed.
All exit doors will be easily operable and will not require the use of a key during the premises hours of operation.
Safety checks are carried out before the premises is opened to the public and a record of these checks is made.
The fire brigade will be called at once to any outbreak of fire, however slight, and details recorded in a Fire Log Book. Access for emergency vehicles is kept clear and free of obstruction.
When disabled people are present, appropriate provision will be made for the safe evacuation of these patrons in the event of an emergency and these patrons will be made aware of these arrangements.
Adequate supply of first aid equipment and materials will be made available on the premises.
The number of patrons will be regularly monitored and a record made of these checks.
The prevention of public nuisance
Between 23:00 and 08:00 there will be total sound containment within the premises.
No regulated entertainment is permitted outside after 23:00.
During opening hours suitable provision will be provided for the collection of smoking related litter.
The outside areas of the premises must be swept and cleared of any smoking related litter at the start and end of trading.
Prominent, clear and legible notices will be displayed at the exit requesting the public to respect the needs of nearby residents and to leave the premises and the area quietly.
During the final hour of opening the music level will be reduced.
Deliveries will be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents. The Premises Licence Holder will ensure that staff who arrive early morning or depart late at night when the premises has ceased trading conduct themselves in such a manner to avoid causing disturbance to nearby residents.
Customers will be asked not to stand around loudly talking in the street outside the premises.
Customers will not be admitted to premises outside of opening hours.
The movement of bins and rubbish outside the premises will be kept to a minimum after 23:00. This will help to reduce the levels of noise produced by the premises.
Any lighting on or outside the premises will be positioned and screened in such a way so as to not cause a disturbance to nearby residents.
Adequate waste receptacles for use by customers will be provided.
The premises will ensure that no amplified sound, including public announcements, in connection with the premises continues beyond the permitted hours of the entertainment.
The protection of children from harm
The premises will operate the Challenge 25 proof of age policy.
Where films are classified by the relevant film classification body, children will only be admitted in accordance with the classification of the film (U, PG, 12A, 15, 18).
