ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
Personal licence holder on site. DPS nominated to oversee operations. Staff aged 21+ and trained regarding alcohol laws, and sale of restricted products. Regular training of staff and regular reviews of company operations and Standard Operating Procedures (S.O.Ps).
The prevention of crime and disorder
1. All alcohol stored at the premises shall be locked in a secure storage area.
2. The premises licence holder shall provide the following information in writing to the licensing authority before any sale of alcohol is carried out (and notify change to this information to the licensing authority within 7 days):
• The trading name of any company that will operate under the licence
• The URL/website address that will be used to accept orders.
3. Delivery vehicles will display branding of the companies trading name.
4. All staff including delivery drivers engaged in licensable activity at the premises will receive training and information in relation to the following (select from the following):
• The Challenge 25 scheme in operation at the premises, including the forms of identification that are acceptable.
• The hours and activities permitted by the premises licence issued under the Licensing Act 2003 and conditions attached to the licence
• How to complete and maintain the refusal register in operation at the premises (in relation to the sale of alcohol).
• Recognising the signs of drunkenness.
• The operating procedures for refusing service to any person who is drunk, under-age or appears to be under-age, or appears to be making a proxy purchase.
• Training shall be recorded in documentary form and shall be regularly refreshed at no greater than 6 monthly intervals. Training records shall be made available for inspection and copying at reasonable times upon request of an authorised officer of a responsible authority.
5. Training records will be retained for at least 12 months
6. The premises shall operate and maintain a digital colour CCTV system to the satisfaction of the Police and Local Authority. As a minimum, the system must:
i. Cover all public areas of the licensed premises, including entry and exit points. This also includes any outside areas under the control of the premises licence holder.
ii. Record clear images permitting the identification of individuals and in particular enable facial recognition images (a clear head and shoulder image) of every person entering and leaving in any light condition.
iii. Continually record whilst the premises are open for licensable activities
iv. Have a constant and accurate time and date generation.
v. Store recordings for a minimum period of 30 days with date and time stamping.
vi. Viewable copies of recordings will be provided on request to the police and local authority officers as soon as is reasonably practicable and in accordance with the Data Protection Act 1998 (or any replacement legislation)
vii. The CCTV system will be capable of downloading images to a recognisable viewable format.
7. There will be clear and legible signage advising patrons that CCTV is in operation outside the venue.
8. The CCTV system will be capable of being downloaded into a recognised viewable format
9. Alcohol shall be sold in sealed containers only.
10. All deliveries of alcohol shall only be delivered to a premises address with a valid postcode and will only be delivered directly to that property.
11. Full name and address details, including postcode, must be given when placing an order.
12. Alcohol can only be delivered to a residential or business address and not to a public place.
13. At the time the order is placed a declaration will be required from the person placing the order that that person is over 18 years of age.
14. Acceptable proof of age shall include identification bearing the customer’s photograph, date of birth and integral holographic mark or security measure. Suitable means of identification would include PASS approved proof of age card, photo-card driving licence and passport. No ID no delivery.
15. There will be a minimum age of 18 for delivery drivers.
16. An alcohol sales refusal register shall be kept at the premises and be maintained by staff including delivery drivers to include details of all alcohol sales refused. The register will include:
• the date and time of refusal
• the reason for refusal
• details of the person refusing the sale
• description of the customer
• any other relevant observations.
17. The refusals register will be made available for inspection and copying on request of an authorised officer of a responsible authority.
18. All entries must be made within 24 hours of the refusal.
19. Delivery will be refused if the driver believes the alcohol is being purchased on behalf of another person aged under 18 years and will be recorded in a refusal register.
20. Customers to be reminded on the website that it is a criminal offence for a person under 18 to purchase or attempt to purchase alcohol and that it is also an offence to purchase alcohol on behalf of a person aged under 18.
Closed, locked doors. No public access. No cash on site. No alcohol consumed on premises, strictly delivery service.
Public safety
No public access, drivers for the delivery, over 21 with clean licence. Late shifts so less foot traffic around area.
The prevention of public nuisance
No consumption of alcohol, anywhere near area, delivery to property only, not just a place. Full I.D. checks. All drivers trained in Challenge 25 and the laws around sale of alcohol.
The protection of children from harm
Use of Deliveroo Uber Eats/Just Eat to order. I.D. checks on those sites, as well as I.D. checks by drivers for every single delivery of alcohol or restricted items. All employees will be 21+.
