ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Supply of alcohol
Any existing conditions attached to existing justices licence
1. Intoxicating liquor may be sold or supplied to the following persons:
a) Persons who have paid a fee for admission to the licensed premises and/or any person on whose behalf an admission fee has been paid
b) Persons attending a bona fide private function at the licensed premises
2. That there will be no off sales
The authorised hours for the sale of alcohol do not prohibit:
1. during the first twenty minutes after the end of authorised hours the consumption of the alcohol on the premises;
2. during the first twenty minutes after the end of authorised hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
3. during the first thirty minutes after the end of authorised hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
4. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
5. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
6. the sale of alcohol to a trader or club for the purposes of the trade or club;
7. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
8. the taking of alcohol from the premises by a person residing there; or
9. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
10 the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
B Regulated Entertainment
· Standard National conditions applying to the existing [public entertainment licence].
1. Occupancy figure of 1000 persons between the hours of 18.00hrs and 04.00hrs Monday to Thursday and 18.00hrs and 06.00hrs Friday and Saturday, 18.00hrs and 01.00hrs on Sundays. The occupancy figure of the premises between the hours of 08.00hrs and 18.00hrs must not exceed 500.
2. It was agreed at committee that the applicant would notify the councils structural engineer if any evacuation takes place, even if it was a false alarm, so that they can study the effects of this on the car parks structure
3. It was also agreed that, once the Council’s structural engineer is happy that all fire safety procedures have been addressed and has confirmed that the car park can take the increased occupancy, this could be increased to 1175 persons. This has been delegated to officers and will not need to be brought back to the Licensing Committee.
· Existing special conditions.
Capacity-1000 between the hours of 18.00hrs and 04.00am Mon to Thurs
18.00hrs and 06.00hrs Fri and Sat
18.00hrs and 01.00hrs Sundays
- 500 between the hours of 08.00hrs and 18.00hrs
· The sale of alcohol is prohibited except under the authority of a premises licence, a club premises certificate or a temporary event notice.
C Special Hours Certificate
1. In relation to the morning on which summer time begins, paragraph (1) of this condition shall have effect
a) with the substitution of references to three o'clock in the morning for references to two o'clock in the morning [or one hour following the hour actually specified in the certificate where the certificate currently requires closure between 1 a.m. and 2 a.m.]
2. The sale of alcohol must be ancillary to the use of the premises for music and dancing and substantial refreshment.
D Steps that have been taken to promote the four licensing objectives
1. Staff banned from drinking on duty
2. Records maintained of any material incidents within or in immediate vicinity of premises
3. Drug disposal facility at entrance
4. Drugs warning notices in place
5. Zero tolerance to drugs use and dealing
6. Policy of banning customers for misbehaviour within or in vicinity of premises where deemed necessary and appropriate
7. Availability of soft drinks, non-alcoholic and /or low alcohol beverages at all times
8. Food available
9. Specific staff training and supervision in assessment of customer consumption and condition
10. CCTV system installed both internally and externally
11. Retention of tapes/discs etc for a minimum of 30 days
12. Licensed door staff to appropriate levels as necessary
13. No cheap alcoholic drinks promotions, cut-price drinks, “package deals”
14. No drinks hoarding
15. Pro-active policy against ‘binge’ drinking
16. Zero tolerance to offensive conduct
17. Plastic drink vessels for draught products
18. Regular glass collection
19. Air-conditioning provided
20. Regular dedicated cleaning of premises
21. Limit on number in premises - 1000 but 500 between the hours of 08.00hrs and 18.00hours
22. Advisory notices re. noise on leaving the building
23. Freephone taxi or similar facility
24. Nominated staff to deal with complaints from neighbours
25. CCTV and/or regular monitoring of external areas of premises at night
26. No entry to anyone under the age of 18 years
27. Warning notices in place in relation to under age drinking
28. Full training for staff in law specifically relating to minors and alcohol and specific photo I/D proof of age requirements
