• ANNEX 1 - MANDATORY CONDITIONS - OFF SALES

   

  No supply of alcohol may be made under this Premises Licence when there is no Designated Premises Supervisor in respect of the Premises Licence.

   

  No supply of alcohol may be made when the Designated Premises Supervisor does not hold a Personal Licence or his Personal Licence is suspended.

   

  Every supply of alcohol under this Premises Licence must be made or authorised by a Personal Licence holder.

   

  (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

   

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

   

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -

   

  (a)               a holographic mark, or

  (b)               an ultraviolet feature.

   

  A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.  For the purposes of this condition -

   

  (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

   

  (b) “permitted price” is the price found by applying the formula P = D + (DxV) where:

   

                (i)   P is the permitted price

  (ii)  D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii) V is the rate of Value Added Tax chargeable in relation to the alcohol as if the Value Added Tax were charged on the date of the sale or supply of the alcohol;

   

         (c) “relevant person” means, in relation to a premises licence -

   

                (i)   the holder of the premises licence,

                (ii)  the designated premises supervisor (if any)

                (iii) the personal licence holder who makes or authorises a supply of alcohol;

   

  (d) “relevant person” means, in relation to a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

   

  (e) “Value Added Tax” means Value Added Tax charged in accordance with the Value Added Tax Act 1994.

   

   

  3. Where the permitted price given by Paragraph (b) of paragraph (2) would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

   

  4. (1) Sub-paragraph (b) below applies where the permitted price given by Paragraph (b) of paragraph (2) on a day (―the first day‖) would be different from the permitted price on the next day (―the second day‖) as a result of a change to the rate of duty or value added tax.

   

  (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  General

  THE PREMISES WILL NOT BE OPEN TO THE PUBLIC. THEY WILL BE USED TO STORE SPIRITS TO BE SOLD ON LINE TO INDIVIDUALS AND TO BARS AND CLUBS THAT WILL HAVE THEIR OWN LICENSES. BARS AND CLUBS ARE RESPONSIBLE FOR PROMOTING THEIR OWN LOCAL LICENSING OBJECTIVES. THE PREMISES WILL BE SECURE FROM UNAUTHORISED ENTRY. THE BOTTLE LABELS WILL CONTAIN RESPONSIBLE DRINKING ADVICE.

  • Off sales of alcohol can only be ordered for delivery to a residential or business address and not to a public place.

  • Full address details, including postcode, must be given when placing an online order for alcohol.

  • At the time an online order for alcohol is placed a declaration will be required from the person placing the order that the person is over 18 years of age.

  • Customers will be reminded  on the website that it is a criminal offence for a person under 18 to purchase or attempt to purchase alcohol and that it is also an offence to purchase alcohol on behalf of a person under 18.

  • All license conditions pertaining to the online sale of alcohol must be part of the ‘Terms and Conditions’ which must be displayed on the website or any other promotional material and expressly brought to the attention of the buyer at the time of ordering in particular the right and obligation of the driver to refuse delivery in specified circumstances.

  • At the point of delivery any person who appears under the age of 25 will be asked for a valid form of identification.  The challenge will be made by the  courier company making the delivery.

  • All alcohol deliveries must be recorded contemporaneously by the driver in a legible log (kept at the premises for 12 months and available for inspection and copying on request of an authorised officer of a responsible authority) to contain:

  • Name and address of person placing an order for alcohol

  • Full delivery address

  • Time and date alcohol delivered

  • Signature of the person taking delivery of alcohol

  • Form of proof of age (where applicable)

  • If delivery refused, basis for refusal

  • Delivery person’s name and signature

  • The only acceptable form of ID will be a passport, UK photo driving license or PASS hologram.

  • Alcohol will not be delivered to any person who is challenged and fails to provide an acceptable form of ID.

  • All delivery sales of alcohol must be paid for at the time of ordering. The payment must be made by a debit or credit card.

  • Delivery times and tracking will be emailed to the customer.

  • Delivery can be refused at any time.

  • A refusal/incident/accident books must be kept at the licensed premises.

  • Any driver employed to deliver alcohol will be over the age of 18 years.

  • Delivery will only be made to the residential or business address given when the order was placed.

   

  The prevention of crime and disorder

  All delivery driver will be aware to watch out for signs of aggression, behaviour, speech, attitude and body language from the customer which could result in a refusal of sale.

   

  Public safety

  Alcohol will not be sold in an open container.

   

  The prevention of public nuisance

  • Delivery drivers shall enter and leave the premises in a quiet and respectful manner.

  • Delivery driver will not play loud music and switch off the engine if waiting for or making deliveries.

   

  The protection of children from harm

  • All delivery drivers will be over the age of 18 years

  • The premises shall operate in accordance with the challenge 25 scheme. The scheme operates on the basis that whilst alcohol may be sold to persons aged 18 years and over, at the point of delivery any person who appears under the age of 25 will be asked for a valid form of identification. The challenge will be made by the person making the delivery.

  • Alcohol will not be delivered to any person who is challenged and fails to provide an acceptable form of id.

  • The Premises Licence Holder or Designated Premises Supervisor shall have a written age verification policy in relation to the sale or supply of alcohol.  This policy will include documented steps taken to prevent adults from purchasing alcohol for or on behalf of children under 18s and will specify a Challenge  25 proof of age requirement before sales of alcohol are made as approved by the Plymouth City Council Trading Standards responsible authority.

  • All staff shall be trained in the legality and procedure of alcohol sales, using the SWERCOTS on-line training pack or equivalent, prior to undertaking the sale of alcohol and then at least every six months.  Training shall be signed and documented and training records will be kept on the premises and be made available to an authorised officer of a responsible authority on request. The documentation relating to training should extend back to a period of three years and should specify the time, date and details of the persons both providing the training and receiving the training.

  We intend to use courier companies who are trained in the legality and procedure of alcohol sales.
