ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
The sale of alcohol is ancillary to the main activity of the provision of games and activities to customers.
There shall be a personal licence holder on duty on the premises at all times when the premises are authorised to sell alcohol.
Drug Use and Safer Nightlife
A written drugs policy shall be in place and operated at the premises. It must detail the actions taken to minimise the opportunity to use or supply illegal substances within the premises. The policy must be made available for inspection and copying upon request by an authorised officer of a responsible authority.
Maximum Occupancies
The maximum number of persons (including staff and entertainers) allowed at the premises shall not exceed 100.
Preventing Glass Injuries
The DPS and/or PLH will risk assess the requirement for drinks to be served in plastic/polycarbonate containers.
We will implement a disclaimer on our website citing our Terms & Conditions that will promote the 4 licencing objectives.
A link to these Terms & Conditions will be within the waiver for each activity.
We will ensure that there are sufficient competent staff on the premises at all times for the purpose of fulfilling the Terms & Conditions of the licence.
All staff will be fully trained in relation to the sale of alcohol and all training and refreshers training records will be kept and filed accordingly.
The prevention of crime and disorder
An incident log shall be kept and maintained at the premises which will include a log of the following, including pertinent details:
i. Any incidents of disorder or of a violent or anti-social nature
ii. All crimes reported to the venue, or by the venue to the police
iii. All ejections of patrons
iv. Any complaints received
v. Seizures of drugs or offensive weapons
vi. Any faults in the CClV system
vii. Any visits by a responsible authority (under the Licensing Act 2003) or emergency service.
Records must be completed within 24 hours of any incident, and will contain the time and date, the nature of the incident, the people involved, the action taken and details of the person responsible for the management of the premises at the time of the incident.
The logs shall be kept for at least 12 months following the date of entry and be made available for inspection and copying upon request of an authorised officer of a responsible authority.
There shall be a personal licence holder available at all times when the premises are authorised to sell alcohol.
SIA Door Staff
The number of SIA registered door staff be in attendance at the premises in the following numbers, days and times listed below and employed until 30 minutes after closing time each day.
Sunday, Monday, Tuesday, Wednesday and Thursday - No SIA registered staff unless risk assessment requires them.
Friday and Saturday Two SIA registered staff from 2100 until close
A written risk assessment with a full review will be completed every quarter, but immediate action will be taken if there is seen to be evidence to suggest an increase to the volume of SIA registered staff are required on any particular day.
The following details for each door supervisor will be contemporaneously entered into a register kept for that purpose:
I. Full name
II. SIA licence/badge number, and registration number of any accreditation scheme recognised by the Licensing Authority (including expiry date of that registration or accreditation)
Ill. The date and time they began their duty
IV. The date and time they completed their duty
V. The full details of any agency through which they have been allocated to work at the premises if appropriate
The register shall be available for inspection and copying at all reasonable times by an authorised officer of a responsible authority.
The register shall be kept at the premises at all times and be so maintained as to enable an authorised officer to establish the particulars of all door supervisors engaged at the premises during the period of not less than 12 months prior to the request.
When SIA registered staff are employed at the premises, they will utilise a minimum of two body worn video devices, Any such device will be capable of recording both audio recordings and visual footage. The recordings will be kept for a minimum of 31 days and will be produced upon request when the premises are open at all other times as soon as reasonably practicable. Staff will receive sufficient training to fully operate the body worn devices.
A search policy shall be in place and will include procedures for the confiscation of prohibited articles, such as drugs and weapons.
A suitable system must be in place to accurately indicate the number of customers (including staff, entertainers etc.) on the premises at any time. This will include the existence of "waivers" who each person taking part in any of our activities must complete as soon as they enter the property.
Activities deemed as 'High Risk' such as axe throwing and Airsoft will be confined to separate areas of the premises as per plan - designated as 'The High Risk Areas'.
'High Risk' materials and items (axes etc.) will be removed from the area and locked in a secure store when activities are not being conducted.
Airsoft Rifles will be secured behind 3 layers of security when the range is not in use. ie Locked in a locker, within the locked store room within the secure Airsoft Range itself.
Axes are secured within a locker within secured the Axe storage cupboard.
No person under the age of 18 will participate in activities deemed as 'High Risk' unless accompanied by an adult.
Participation in activities deemed as 'High Risk' such as axe throwing or Air-soft will cease by 2200hrs daily.
Children under the age of 16 must be accompanied by an adult at all times.
No person under 18 will be allowed entry to the premises after 1900hrs, unless specifically booked in to an activity and accompanied by the appropriate adult supervision.
The 'High Risk' area of the premises where activities such as axe throwing are conducted will be an alcohol free zone.
The suitability of participants in these 'High Risk' activities will be assessed by a dedicated member of staff who if deemed necessary will utilise a police approved hand held breathalyser device as part of such an assessment.
Any such assessment will be conducted prior to any participation in a 'High Risk' activity.
A member of suitably trained staff will be present at all times in the area of the premises designated as the 'High Risk' areas.
There will be a dedicated first aid station containing a trauma pack as well as a suitable first aid kit for the premises. Notices shall be displayed advertising patrons of the location of first aid station. Staff holding a suitable up to date medical first aid qualification shall be on duty at the premises whenever activities deemed to be 'High Risk' are conducted.
The premises shall operate and maintain a digital colour CCTV system to the satisfaction of the Police, the system must:
i. Cover all public areas of the licensed premises, including entry and exit points. This also includes any outside areas under the control of the premises licence holder.
ii. Record clear images permitting the identification of individuals and in particular enable facial recognition images (a clear head and shoulder image) of every person entering and leaving in any light condition.
iii. Continually record whilst the premises are open for licensable activities and during all times when customers remain on the premises.
iv. Have a constant and accurate time and date generation.
v. Store recordings for a minimum period of 31 days with date and time stamping.
vi. Viewable copies of recordings will be provided on request to the police and local authority officers as soon as is reasonably practicable and in accordance with the Data Protection Act 1998 (or any replacement legislation)
vii. The CCTV system will be capable of downloading images to a recognisable viewable format.
The CCTV system will be fully compliant with the guidance contained in the Information Commissioner's Office (ICO) guidance document https://ico.org.uk/fororganisations/guide-to-data protection/cctv/ (or any renewed equivalent guidance which Is subsequently issued).
If the CCTV equipment (including any mobile units in use at the premises) breaks down the Licensing Authority and the Police must be informed as soon as is reasonably practicable. This information shall be contemporaneously recorded in an incident report register and shall include the time, date and means this was done and to whom the information was reported. Immediate steps must be taken to put the equipment back into action. The Licensing Authority and the Police shall be informed when faults are rectified.
A staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises are open. This staff member must be able to provide an authorised officer of a responsible authority copies of recent CCTV images or data with the absolute minimum of delay when requested (in accordance with the Data Protection Act 1998 or any replacement legislation).
Public safety
Full in-house staff training is provided on Health & Safety & First Aid.
Any high risk activities with be hosted at all times and equipment locked away from guests when not in use.
The capacity of the premises will be identified through formal written Fire Risk Assessment.
Operational capacities shall be recorded by bookings, ticket, admission sale records, clicker, or other such counting device, a record made and kept for a minimum of 60 days.
All records including the Fire Risk Assessment shall be made available upon reasonable request of authorised agents of a Responsible Authority.
The prevention of public nuisance
Notices will be put up advising customers to use the outside areas quietly.
Customers will not be allowed to take an open vessel of alcohol outside the premises.
No customers will be allowed entry or re-enter to the premises from 2230 daily.
The exit will have a "Please Leave quietly" sign.
There will be a 30 min cooling down period so guests can relax and leave quietly at the end of the day.
Staff/Door Staff will instruct customers to leave quietly and through a nominated exit to ensure we do not disturb our neighbouring businesses within the local area.
No glass bins will be emptied outside after 21 :00 and no music will be heard from our venue from the outside.
Any large groups of our guests that congregate outside our premises after we close will be dispersed.
Any speakers should face away from all entrances/exits to the premises.
Recorded music will not be played in the outside areas of the premises.
There is provision of litter bins throughout the premises.
The protection of children from harm
No person under 18 will be allowed entry to the premises after 1900hrs, unless specifically booked in to an activity and accompanied by the appropriate adult supervision.
All staff engaged in licensable activity at the premises will receive training and information in relation to the following:
i. The Challenge 25 scheme in operation at the premises, including the forms of identification that are acceptable.
ii. The hours and activities permitted by the premises licence issued under the Licensing Act 2003 and conditions attached to the licence.
iii. How to complete and maintain the refusal register in operation at the premises
(in relation to the sale of alcohol).
iv. Recognising the signs of drunkenness.
v. The operating procedures for refusing service to any person who is drunk, under-age or appears to be under-age, or appears to be making a proxy purchase.
vi. Action to be taken in the event of an emergency, including reporting an incident to the emergency services.
Training shall be recorded in documentary form and shall be regularly refreshed at no greater than 12 month intervals. Training records shall be made available for inspection and copying at reasonable times upon request of an authorised officer of a responsible authority.
Training records will be retained for at least 12 months.
