ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
THE PREVENTION OF CRIME AND DISORDER
1. CCTV shall be installed, operated, and maintained at all times the premises is open for licensable activities:
o (a) System checked every two weeks; records kept and available on request.
o (b) Police informed if non-operational for over one business day.
o (c) One camera shall provide a clear, full-length image of anyone entering.
o (d) System shall provide full coverage of the interior and entrance area.
o (e) Recordings shall be in real time with date and time stamping.
o (f) At least one staff member shall be on duty trained to operate the system to provide footage to Police or authorised officers on request.
o (g) Recordings shall be retained for 31 days and footage provided free of charge within 24 hours of request, subject to Data Protection provisions.
2. An incident log shall be maintained and made available on request to Police or authorised officers, recording:
o (a) Allegations of crime or disorder
o (b) Complaints received
o (c) CCTV faults
o (d) Visits by relevant authorities or emergency services
o (e) Refusals of alcohol sales
2a. The refusals log shall be checked and signed monthly by the DPS.
3. No super-strength beer, lager, cider or spirit mixtures of 6.5% ABV or above shall be sold, except for premium products sold in glass bottles.
4. No single cans or bottles of beer, lager or cider shall be sold.
5. All sales of alcohol shall be in sealed containers only and not consumed on the premises or its immediate vicinity.
6. Challenge 25 shall be operated. Only passports, photo driving licences, HM Forces ID cards, or PASS-accredited proof of age cards will be accepted as proof of age. Notices shall be displayed at the till reminding staff to check ID where necessary.
7. The licence holder shall ensure all staff are trained on:
o Premises licence conditions
o Age-restricted products
o CCTV operation (if left in charge)
o Visits from authorised officers
o Licensing Objectives
o Identifying persons under 25, making challenges, acceptable proof of age and checking, making and recording refusals, avoiding conflict, responsible retailing
Training shall be signed by staff, provided on induction, and refreshed every six months. Training records shall be available to Police or authorised officers on request.
8. Staff training records shall be kept and made available to Police or authorised officers on request, including responsibilities under the Licensing Act 2003 with refresher training at least every 6 months.
9. A record of all refused sales of alcohol shall be maintained and made available upon request to Police or authorised officers.
10. Notices shall be prominently displayed at entry/exit points stating:
o (a) CCTV is in operation and Challenge 25 is enforced.
o (b) Underage and proxy sales are offences under the Licensing Act.
o (c) Permitted licensable hours and opening times.
o (d) No street drinking.
o (e) Customers are requested to respect residents, leave quietly, not loiter outside or in the vicinity, and dispose of litter responsibly.
11. Prominent signage indicating the permitted hours for alcohol sales shall be displayed before entering the premises and at the point of sale.
12. A stock control system shall be operated to identify where and when alcohol or tobacco products were purchased.
13. Invoices (or copies) for all alcohol and tobacco products shall be retained on site and made available to Council, Police, or HMRC officers upon request.
14. No alcohol or tobacco products shall be purchased or taken from sellers calling at the shop.
15. No spirits shall be purchased in resealed containers.
PUBLIC SAFETY
16. The premises shall be maintained in a safe condition at all times to ensure the safety of staff and customers.
17. All emergency exits and escape routes shall be kept unobstructed, clearly identifiable, and maintained in good working order.
18. The licence holder shall ensure that the public area of the premises is kept free from trip hazards and slip risks, with any spillages cleaned immediately.
19. Fire safety equipment shall be inspected and maintained at least annually, with records kept on site for inspection by the relevant authorities.
THE PREVENTION OF PUBLIC NUISANCE
20. The DPS and premises management shall take all reasonable steps to ensure that the premises does not cause a public nuisance to local residents and businesses.
21. Notices shall be prominently displayed at all exits requesting customers to leave the premises and area quietly and to respect local residents, particularly during the evening and night-time hours.
22. Staff shall actively monitor the immediate vicinity of the premises to disperse groups loitering outside and to prevent antisocial behaviour.
23. No waste or recyclable materials, including bottles, shall be moved, removed, or placed in outside areas between 21:00 hours and 08:00 hours the following day to minimise noise disturbance to nearby properties.
24. Deliveries to the premises shall only take place between 08:00 and 20:00 hours to prevent disturbance to nearby residents and businesses.
25. The licence holder shall ensure that the frontage of the premises is kept tidy at all times and is swept at close of business, with litter and cigarette ends disposed of appropriately.
THE PROTECTION OF CHILDREN FROM HARM
26. The premises shall operate a Challenge 25 policy. Any person who appears to be under the age of 25 shall be required to produce an acceptable form of identification to prove they are over 18 before any sale of alcohol is made.
27. Acceptable forms of identification are:
A valid passport
A valid photo driving licence
A HM Forces identification card containing a photograph and date of birth
A PASS-accredited proof of age card bearing the PASS hologram
28. Notices advising customers of the Challenge 25 policy shall be prominently displayed at all entry points, at the till point, and where alcohol is displayed for sale.
29. Staff shall receive training on the law relating to underage sales and the operation of Challenge 25, including:
The prohibition on the sale of alcohol to persons under 18 under Section 146 Licensing Act 2003
The offence of allowing the sale of alcohol to a child under Section 149 Licensing Act 2003
Proxy sales, including offences under Section 149(3) Licensing Act 2003, and refusal protocols
Procedures for requesting identification and verifying authenticity
Recording refusals in the refusals log
This training shall be provided on induction and refreshed every six months, with written records kept, signed by staff, and made available to Police or authorised officers upon request.
30. A refusals register shall be maintained to record all refusals of alcohol sales, including:
The date and time of refusal
The reason for refusal
The name or description of the person refused
The initials of the staff member refusing the sale
The refusals register shall be reviewed monthly by the DPS and made available to authorised officers upon request.
31. The premises licence holder shall ensure that no adult attempts to purchase alcohol for a person under 18 (proxy sales). Staff shall be trained to be vigilant to such attempts, including observing groups where adults purchase alcohol while accompanied by young persons.
32. Staff shall monitor young people outside the premises and discourage loitering to prevent the premises becoming a gathering place for underage persons.
33. Alcohol shall not be sold in any open container or be consumed on the premises or its immediate vicinity to minimise the risk of underage consumption nearby.
