ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Supply of alcohol
Any existing conditions attached to existing justices licence
The authorised hours for the sale of alcohol do not prohibit:
1. during the first twenty minutes after the end of authorised hours the consumption of the alcohol on the premises;
2. during the first twenty minutes after the end of authorised hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
3. during the first thirty minutes after the end of authorised hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
4. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
5. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
6. the sale of alcohol to a trader or club for the purposes of the trade or club;
7. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
8. the taking of alcohol from the premises by a person residing there; or
9. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
10. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
B Conditions agreed with Environmental Health Representative
1. An announcement will be made prior to closing requesting patrons co-operation in leaving the premises and vicinity as quietly and quickly as possible
2. Patrons will be asked not to stand around talking in the street outside the premises; and asked to leave the vicinity quickly and quietly
3. A specific taxi operator has been nominated for staff and customers use. The company’s telephone number is advertised to customers. The operator, and all drivers, are aware that they should arrive and depart as quietly as possible, should not sound vehicle horns as a signal of their arrival or leave engines idling unnecessarily. In addition, staff will leave as quietly as possible, particularly at night and early in the morning.
4. Staff will check prior to entertainment, and periodically during the entertainment, that all windows and doors are shut
5. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment
6. Management will control the sound levels of the music/entertainment
7. Before 00.00hrs
To prevent entertainment being intrusive, noise emanating from the premises will not be clearly audible one metre from the façade of the nearest residential property
8. No live music or similar entertainment (other than background recorded music) beyond 00.00hrs
9. Between 00.00hrs and 02.00hrs
Noise emanating from the premises will not be distinguishable above background levels one metre from the façade of the nearest residential property
C Steps that have been taken to promote the four licensing objective
The prevention of Crime and Disorder
1. All external areas are well lit
2. Staff are trained in our policy and assistance is always available
3. HACCP policy in place
4. Drink drive posters on site
Public Safety
1. Certificates held include, Health & Safety, Health safety and fire, electric and gas
2. All emergency lighting, fire fighting equipment, fire alarms and illuminating signs are clearly displayed and maintained as required.
3. Health and Safety policy in place and adhered to
4. A fire alarm test is carried out weekly
5. There is a first aider and first aid facilities at the premises
6. We promote a licensed taxi service
7. Accident/incident book on site for staff and public
The Prevention of Public Nuisance
1. All the windows are lockable and all windows and doors remain closed during all live and amplified music sessions
2. When required staff will order taxis for customers and customers are seen off the premises and encouraged to disperse at closing time
3. There will be no aggressive drinks promotions (i.e. 2 for 1’s, heavy discounting/happy hours)
4. Customers are verbally reminded to leave the premises quietly
The Protection of Children from Harm
1. Unaccompanied children not allowed on site
2. Fully enclosed beer garden and court yard
