ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
The prevention of crime and disorder
1. All staff engaged in licensable activity at the premises will receive training and information in relation to the following
i. The Challenge 25 scheme in operation at the premises, including the forms of identification that are acceptable.
ii. The hours and activities permitted by the premises licence issued under the Licensing Act 2003 and conditions attached to the licence.
iii. How to complete and maintain the refusal register in operation at the premises (in relation to the sale of alcohol).
iv. Recognising the signs of drunkenness.
v. The operating procedures for refusing service to any person who is drunk, under-age or appears to be under-age, or appears to be making a proxy purchase.
vi. Action to be taken in the event of an emergency, including reporting an incident to the emergency services.
2. Training shall be recorded in documentary form and shall be regularly refreshed at no greater than 6-month intervals. Training records shall be made available for inspection and
copying at reasonable times upon request of an authorised officer of a responsible authority.
3. Training records will be retained for at least 12 months
4. An incident book shall be maintained to record any activity of a violent, criminal, or anti- social nature. The record will contain the time and date, the nature of the incident, the people involved, the action taken and details of the person responsible for the management of the premises at the time of the incident
5. The Premises Licence Holder or Designated Premises Supervisor shall ensure a sales refusal register is maintained to include details of all alcohol sales refused and the reason for
refusal. The refusals register should be made available to an authorized enforcement officer on request.
6. The Premises Licence Holder will ensure that a CCTV system is fully compliant with the guidance contained in the Information Commissioner’s Office (ICO) guidance document
(www.informationcommissioner.gov.uk) regarding installation of CCTV is provided at the
premises.
7. Images shall be retained for a minimum of 31 days
8. The CCTV system shall be capable of downloading images to a recognizable viewable format.
9. At all times the premises are open for business a member of staff shall be present who is capable of operating the CCTV system and downloading images at the request of police or
other authorised officer
10. Alcohol for consumption on the premises, will only be consumed by persons who are seated at tables and served by waiter/waitress service.
11. Alcohol can only be ordered for delivery to a residential or business address and not to a public place.
12. Alcohol can only be ordered for delivery to the person placing the order.
13. Full address details, including postcode, must be given when placing an online order for alcohol.
14. At the time an online order for alcohol is placed a declaration will be required from the person placing the order that the person is over 18 years of age.
15. Customers will be reminded that it is a criminal offence for a person under 18 to purchase or attempt to purchase alcohol and that it is also an offence to purchase alcohol on behalf of a person under 18.
16. All staff shall be trained in the legality and procedure of alcohol sales, using an on-line training pack or equivalent, prior to undertaking the sale of alcohol and then at least every six months. Training shall be signed and documented, and training records will be kept on the premises and be made available to an authorised officer of a responsible authority on request. The documentation relating to training should extend back to a period of three years and should specify the time, date, and details of the persons both providing the training and receiving the training.
17. There will be in place a written age verification policy in relation to the sale or supply of alcohol, which will specify a Challenge 25 proof of age requirement. This means that staff
working at the premises must ask individuals who appear to be under 25 years of age, attempting to purchase alcohol, to produce identification. The only acceptable identification
documents will be:
- A photo driving licence
- A passport
- An identification card carrying the PASS hologram
Unless such identification is produced the sale of alcohol must be refused.
CCTV installed at entrance, exits and various other areas of the premises.
Public safety
A log book or recording system shall be kept upon the premises for inspection by authorised persons.
The prevention of public nuisance
Between 23:00 and 08:00 there will be total sound containment within the premises.
The pavement at the front of the premises must be kept clean. This area must be swept and cleared of any litter at the start and end of trading.
During opening hours suitable provision will be provided at the front of the premises for the collection of smoking related litter.
Prominent clear and legible notices will be displayed at the exit requesting the public to respect the needs of nearby residents and to leave the premises quietly.
Deliveries of goods necessary for the operation of the business will be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents.
The Licensee will ensure that staff who arrive early morning or depart late at night when the business has ceased trading conduct themselves in such a manner to avoid causing disturbance to nearby residents.
Customers will be asked not to stand around loudly talking in the street outside the premises.
The movement of bins and rubbish outside the premises will be kept to a minimum after 11pm to reduce the level of noise produced by the premises.
Any lighting on or outside the premises will be positioned and screened in such a way so as not to cause a disturbance to nearby residents.
Adequate waste receptacles for use by customers will be provided in the local vicinity.
The area marked on the plan as the outside yard will not be used for the serving of meals or the playing of music.
