• ANNEX 1 - MANDATORY CONDITIONS - OFF SALES

   

  No supply of alcohol may be made under this Premises Licence when there is no Designated Premises Supervisor in respect of the Premises Licence.

   

  No supply of alcohol may be made when the Designated Premises Supervisor does not hold a Personal Licence or his Personal Licence is suspended.

   

  Every supply of alcohol under this Premises Licence must be made or authorised by a Personal Licence holder.

   

  (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

   

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

   

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -

   

  (a)               a holographic mark, or

  (b)               an ultraviolet feature.

   

  A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.  For the purposes of this condition -

   

  (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

   

  (b) “permitted price” is the price found by applying the formula P = D + (DxV) where:

   

                (i)   P is the permitted price

  (ii)  D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii) V is the rate of Value Added Tax chargeable in relation to the alcohol as if the Value Added Tax were charged on the date of the sale or supply of the alcohol;

   

         (c) “relevant person” means, in relation to a premises licence -

   

                (i)   the holder of the premises licence,

                (ii)  the designated premises supervisor (if any)

                (iii) the personal licence holder who makes or authorises a supply of alcohol;

   

  (d) “relevant person” means, in relation to a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

   

  (e) “Value Added Tax” means Value Added Tax charged in accordance with the Value Added Tax Act 1994.

   

   

  3. Where the permitted price given by Paragraph (b) of paragraph (2) would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

   

  4. (1) Sub-paragraph (b) below applies where the permitted price given by Paragraph (b) of paragraph (2) on a day (―the first day‖) would be different from the permitted price on the next day (―the second day‖) as a result of a change to the rate of duty or value added tax.

   

  (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  GENERAL

   

  Customers shall place their orders on-line. During the order process the customer shall be asked to verify / confirm that they, and (in the case of ‘gift’ orders) the recipient, is over the age of 18 at the time of order. This will be a mandatory field and no orders can be processed without confirmation that the receiver is over the age of 18.

  The premises shall be used purely as a distribution point for the on-line orders, stock (Gin) will be held on the premises for that purpose. The premises shall not be open to the public and therefore shall have no trade counter or any other activities at the premises whereby they interact directly with the public.

  Deliveries and Despatches - will be made by Royal Mail / Courier service using small commercial vehicles and will only be accommodated within the above stated operating hours.

  THE PREVENTION OF CRIME AND DISORDER

   

  Management Controls

   

  All staff shall be fully trained to perform their role. They will also be trained in the contents of the premises licence including times of operation, licensable activities and all conditions.

   

  Training shall be recorded in documentary form that will be available for inspection at the request at all reasonable times by an authorised officer from a relevant responsible authority. The records will be retained for at least 12months.

  Any person managing or supervising staff in the sale of alcohol or other licensable activity in the absence of the DPS shall be the holder of a personal licence obtained from a nationally recognised body.

  All staff shall be suitably trained in the operating procedures for refusing to fulfil an order to any person who is under-age or appears to be under-age.

  There shall be no public admission to the premises.

  Glassware and Bottles

   

  Orders will be fulfilled in 25ml / 50ml glass containers and customers shall be encouraged to recycle all containers.

  Any glass, or other materials, to be disposed of at the premises shall be done so in accordance with the City Business Park recycling objectives, i.e. recycling will be optimised using the City Business Park facilities

  Restrictions on Drinking Areas

   

  There shall be no consumption of alcohol on the premises

   

  THE PREVENTION OF PUBLIC NUISANCE

   

  Noise Precautions

   

  As the premises shall not be open to the public, no special measures to combat noise shall be required, however the applicant shall ensure that with respect to their own duties / operations;

  Pneumatic tyres (or equivalent) will be fitted to any moving work equipment to be used outside. (e.g. Bins, trolleys, roll cages etc)

   

  Any moveable furniture will be fitted with rubber (or equivalent) feet.

  Delivery/Collection/Storage

   

  The handling of bottle disposal and similar items shall not take place before 09:00 hours or after 17:00 hours when the noise generated could cause a nuisance particularly outside the buildings.

   

  The delivery and collection of goods is restricted to between the hours of 09:00 hours and 17:00 hours and shall be undertaken by light commercial vehicles only.

   

  Litter

   

  All the rubbish produced by the premises shall be stored securely in a designated area or in a bin with a tight fitting and lockable lid. All shall then be disposed of in-line with the Plymouth City Councils recycling policy on site.

   

  THE PROTECTION OF CHILDREN FROM HARM

   

  Proof of Age Scheme

   

  The Premises Licence Holder or Designated Premises Supervisor shall ensure that all staff, are trained in the legality and procedure of alcohol sales, using the SWERCOTS on-line training pack or equivalent, prior to undertaking the sale of alcohol and then at least every six months. Training shall be signed and documented and training records will be kept on the premises and be made available to an enforcement officer on request. The documentation relating to training should extend back to a period of three years and should specify the time, date and details of the persons both providing the training and receiving the training.

   

  Unaccompanied children (under 18) will not be allowed upon the premises.

   

  The Premises Licence Holder or Designated Premises Supervisor shall have a written age verification policy in relation to the sale or supply of alcohol. This policy will include documented steps taken to prevent adults from purchasing alcohol for or on behalf of children under 18s, in short, the policy shall state the following conditions which the Applicant shall operate under;

   

  For on-line sales;

   

  The website checkout process shall be as follows;

  1)              As a first line deferent. the customer must tick a box to confirm that the purchaser is over the age of 18. An appropriate ‘warning’ statement shall be clearly positioned beside this box. If this box is not ticked, the checkout shall not be able to proceed.

   

  2)              The customer shall be asked to enter their date of birth. This shall be a mandatory field and without data entry the checkout process cannot be completed. All orders received by Little Gin Box shall be checked for date of birth to ensure no orders to under 18 are fulfilled. Any orders from under 18 shall have the order cancelled and money refunded.

   

  3)              Payment - payment shall be ideally made by credit card and the site shall explain that this is for age verification processes.

   

  4)              Alternative payment - If the customer prefers not to pay be credit card, other methods shall be accepted. i.e. PayPal or Debit Card, however if the customer choose to pay by a method other than credit card we shall still take a credit card number and details and a small (1p) transaction shall be processed against the credit card to ensure that the details are valid.

   

  5)              If at anytime the staff of Little Gin Box are in anyway suspicious regarding a transaction then the order shall be cancelled and NOT fulfilled.

   

  The Licence Holder or Designated Premises Supervisor shall ensure that new staff receive induction in the legality and procedure of alcohol sales, prior to undertaking the sale of alcohol. Training shall be signed and documented and training records be made available to an enforcement officer on request.
