ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Conditions that have been agreed with the Police Licensing Authority
o Where regulated entertainment is available at the premises from 21:00 hours onwards, a minimum of two SIA doorstaff will be employed and retained until close of business.
Steps taken in order to promote the four Licensing objectives:
Crime & Disorder
1. Whenever the designated premises supervisor is not at the premises another responsible person will be nominated by the designated premises supervisor as being the person to manage the premises.
2. The premises licence holder and/or the designated premises supervisor or a person nominated by them shall be a member of and regularly attend meetings of any pubwatch scheme for the area within which the premises are located (if relevant).
3. A CCTV system covers the public areas inside the premises (excluding lavatories). It will be maintained in good working order at all times. The images recorded will be of good quality and will be retained for 31 days and made available to the authorities on request.
4. Playback facility of at least 16 frames per second.
5. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
6. Drugs warning notices will be on display throughout the premises publicising a “Zero Tolerance” to drugs message.
Public Safety
1. No open bottles or other vessels will be permitted to be taken form the premises.
2. Wherever possible only glasses, which are made of ‘toughened/safety glass’, will be used on the premises.
3. There will be regular glass collection made in all area of the premises.
4. Free drinking water to be made available at all times from the bar. The fact that this service exists shall be clearly advertised within the premises. A good selection of soft drinks will also be sold at the premises.
5. A daily incident logbook detailing all incidents of note at the premises or in the immediate vicinity e.g. slips, accidents, entry refusals and incidents of disorder etc. The log will detail the date, time, type of incident, brief circumstances, action taken and person dealing. The logbook will be made available for up to six months Police or any other responsible authority for inspection, if required. All relevant incidents will be reported to the police at the earliest opportunity.
6. There will be no irresponsible drinks promotions at the premises.
7. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure their safety.
8. Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker should operate at a current not exceeding 30 mA and should comply with BS 4293. The device must be tested monthly and tests will be recorded.
9. The Gas System including appliances will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
10. Free drinking water will be available at all times.
11. The sanitary accommodation consists of:
Male WC’s: 1 Female WC’s: 2
Male urinals: 1 (capacity 5 people)
WHBs: 1 Female WHBs: 2
12. All sanitary accommodation will be maintained in good working order.
13. Suitable and sufficient lighting will be provided to the toilets.
14. We will ensure that at all times there is at least one suitably trained first aider, who shall be responsible for first aid, on duty when the public are present.
15. First aid provision will be available for the use of patrons.
16. Suitable protective equipment will be provided to deal with hypodermic needles, blood spillages and other body fluids. Procedures will be in place to ensure that body fluids are dealt with in a safe manner to avoid the risk of communicable disease.
17. Gangways, exit routes and steps will be maintained in good order with non-slippery and even surfaces. Edges of steps and stairways will be conspicuously marked.
18. All staff have received suitable training regarding their duties in an emergency and in general safety precautions.
19. The manager or senior member of staff will check the premises prior to opening to ensure there are no risks to patrons and that all safety precautions are in place.
20. Regular glass and bottle collection will be undertaken throughout opening hours.
21. A means of addressing patrons during operating hours, which can be heard above entertainment, or a means of interrupting the entertainment to make important safety announcements will be available.
22. All areas with sudden changes in height will have guarded edges to prevent patrons falling.
23. Lasers will not be used on the premises without prior consultation with Environmental Regulation Service, and compliance with HS(G) 95.
24. The patrons / audience will not be exposed to an event Leq of 107 dB(A) and the peak sound pressure level should not exceed 140 dB. Where the event Leq is likely to exceed 96 dB(A) advise the audience will be advised of the risk to their hearing in advance, e.g. either on tickets, advertising or on entry.
25. When entertainment of an adult nature is provided:
a. Only activities agreed with the Licensing Authority will take place on the premises.
b. The agreed activities will only take place in the designated area on the attached plan.
c. No performance will take place in areas which can be seen from the outside of the premises.
d. Secure private changing facilities will be provided for performers.
e. The audience shall not be permitted to participate.
f. While the entertainment is taking place no person under the age of 18 shall be on the premises.
g. All entrances shall have a clear notice stating “NO PERSON UNDER THE AGE OF 18 WILL BE ADMITTED”.
Public Nuisance
1. At least 15 minutes before the last sale of alcohol the atmosphere will be adjusted to create a calm period of wind down. An example will be the turning up of lights and switching off of any background music.
2. The DPS will ensure that the level of noise emitting from the premises is kept to a minimum so as to not disturb the residential neighbours.
3. Notices will be displayed at entrances/exits requesting patrons to leave the premises quietly and have respect for the residential neighbours.
4. Suitable signage will be positioned at exits to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises.
5. An announcement will be made prior to closing requesting patrons co-operation in leaving the premises and vicinity as quietly and quickly as possible.
6. Entrances are provided with lobbies with automatic door-closers. The lobbies are in use throughout the time of entertainment.
7. The emergency exits are well fitted and are kept shut during opening hours.
8. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/ entertainment.
9. Management will control the sound levels of the music/ entertainment.
10. Before 23:00 hrs to prevent entertainment being intrusive, noise emanating from the premises will not be clearly audible 1 metre from the façade of the nearest residential property.
11. Between 23:00 hrs and 00:00 hrs (midnight), to prevent entertainment being intrusive, noise emanating from the premises will not be clearly distinguishable above other noise 1 metre from the façade of the nearest residential property.
12. Between 00:00 hrs (midnight) and 02:00 hrs noise emanating from the premises will not be distinguishable above background levels 1 metre from the façade of the nearest residential property.
13. After 02:00 hrs until 08:00 hrs total sound containment within the premises.
14. Provision of mechanical ventilation and air conditioning systems will not allow noise breakout from the premises or cause a nuisance by its operation.
15. Where plant and machinery has the potential to cause a noise problem it will be positioned in such a way that the building structure provides as much screening as possible for nearby noise-sensitive properties. Alternatively, or additionally, control measures such as acoustic enclosures, acoustic louvers, silencers, or additional acoustic screening will be considered.
16. Regular maintenance will be carried out on all plant and machinery to ensure that noise disturbance from such sources is kept to a minimum.
17. The delivery of goods is restricted to the normal working day.
18. Bottle skips and bins containing cans or bottles will not be emptied outside after 23:00 hrs but will be dealt with the next day during normal office hours.
19. The movement of bins and rubbish outside the premises will be kept to a minimum after 23:00 hrs.
20. Ventilation equipment will be regularly cleaned and maintained to control the levels of odour generated by the premises.
21. All the rubbish produced by the premises will be stored securely in a designated area or in a bin with a tight fitting lid.
22. All commercial waste collection will be arranged for after 08:00 hrs.
Protection of Children
1. Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:

2. Proof of age checks will take place inside the premises by staff whenever they have doubt about a person’s age.
3. Notices obtained from Police publicising the Challenge 21 initiative shall be clearly displayed at the entrance to the premises and behind the bar area at all times.
A Supply of alcohol
Any existing conditions attached to existing justices licence
The authorised hours for the sale of alcohol do not prohibit:
1. during the first twenty minutes after the end of authorised hours the consumption of the alcohol on the premises;
2. during the first twenty minutes after the end of authorised hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
3. during the first thirty minutes after the end of authorised hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
4. consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
5. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
6. the sale of alcohol to a trader or club for the purposes of the trade or club;
7. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
8. the taking of alcohol from the premises by a person residing there; or
9. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
10. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
