ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A Supply of alcohol
Any existing conditions attached to existing justices licence
The authorised hours for the sale of alcohol do not prohibit:
1. during the first twenty minutes after the end of authorised hours the consumption of the alcohol on the premises;
2. during the first twenty minutes after the end of authorised hours, the taking of the alcohol from the premises unless the alcohol is supplied or taken in an open vessel;
3. during the first thirty minutes after the end of authorised hours the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals;
4. consumption of the alcohol on the premises or the sale or supply of alcohol to any person residing in the licensed premises;
5. the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
6. the sale of alcohol to a trader or club for the purposes of the trade or club;
7. the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
8. the taking of alcohol from the premises by a person residing there; or
9. the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
10. the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

Subject to provisions of the Cinema Act
D Childrens Certificate
1. This certificate shall be operational between the following hours and on the following days, namely:
Monday - Saturday 11.00 - 21.00hrs
Sunday - 12.00 - 21.00hrs
2. Meals and beverages other than intoxicating liquor shall be available for consumption in the area(s) to which the Certificate relates at all times when the Certificate is operational. (Area’s shown on plan)
Steps taken to promote the four licensing objectives:
General
1. CCTV is installed and working to the satisfaction of the Police and Licensing Authority.
2. Recordings will be maintained for an appropriate period of time and will be provided to the Police when required for evidential purposes
3. A notice will be displayed at the entrance to the premises advising that CCTV is in operation
4. We have a capacity limit of 190 to prevent overcrowding
5. Free drinking water will be available at all times when the premise is open to the public
6. Seats are available to accommodate 60% of the maximum capacity of the premises
7. The premises have a designated telephone taxi service
The Prevention of Crime and Disorder
8. The premises use toughened pint glasses for the supply of alcohol
9. Customers carrying open bottles or glasses are not permitted on to the premises any time
10. Customers are not permitted to take open containers of alcoholic or soft drinks away from the premises
11. All bottles and glasses are removed from public areas as soon as they are finished with or empty
12. We have an anti drugs policy that has been agreed following discussion with the Police
13. A detailed ‘customer conduct’ poster is displayed warning customers that if they act in an inappropriate manner they could be barred from the premises
Public Safety
14. We have conducted a suitable fire risk assessment at the premises and implemented the necessary controls
15. All exit doors are easily operable without the use of a key card, code or similar means
16. Exit doors are regularly checked to ensure they function satisfactorily
17. All fire doors are maintained effectively self closing and will not be held open other than by approved devices
18. Emergency lighting tests are conducted monthly
19. All fire exits and means of escape are signed accordance with BS5499
20. An evacuation policy will be in place that is to the satisfaction of the fire Authority. All Staff members will be trained in the evacuation policy
21. Adequate and appropriate first aid equipment and materials are available on the premises
22. In the absence of adequate daylight, suitable and sufficient lighting is provided and maintained in any area accessible to the public
23. Fire safety signs are adequately illuminated
24. Emergency lighting is installed and regularly maintained
25. The premises have a satisfactory NICEIC or ECA periodic electrical installation report. An inspection is carried out every year, and a new report obtained each time

The Prevention of Public Nuisance
29. Doors and windows will be kept closed whenever regulated entertainment is carried on and in any event after 23.00hrs to reduce breakout of noise
30. Amplified music shall not be played at a level that will cause unreasonable disturbance to the occupants of any properties in the vicinity
31. The outside areas will be closed and cleared of customers after the hours of 23.00 hours
32. Prominent, clear and legible notices are displayed at all exits requesting patrons to respect the needs of local residents and to leave the premises and the area quietly
33. The placing of bottles into receptacles outside the premises is only permitted to take place between the hours of 09.00 hours and 17.00hours to minimise the disturbance to nearby premises
34. All ventilation and extract systems are designed and maintained so as to prevent noxious smells causing a nuisance to nearby properties
35. The premises has a waste collection contract with Plymouth City Council for the removal of waste weekly
The Protection of Children from Harm
36. We have a proof of age policy, requiring the production of Identity Cards. All staff will be trained in this policy
37. A sign will be displayed stating it is an offence for persons under the age of 18 to purchase or attempt to purchase alcohol
Conditions imposed by Environmental Health Authority
Public Nuisance
1. Patrons will be asked not to stand around talking in the street outside the premises or any car park, and asked to leave the vicinity quickly and quietly
2. A specific taxi operator has been nominated for staff and customers use. The company,s telephone number is advertised to customers. The operator and all drivers are aware that they should arrive and depart as quietly as possible, should not sound vehicle horns as a signal of their arrival or leave engines idling unnecessarily. In addition, staff will leave as quietly as possible, particularly at night and early in the morning
3. Staff will check prior to entertainment, and periodically during the entertainment, that all windows and doors are shut.
4. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring premises at the start of the activity/entertainment and periodically throughout the activity/entertainment and take action to reduce noise levels if they are found to be excessive/distinguishable above background levels at the nearest residential property.
5. Management will control the sound levels of the music/entertainment
Before 12 Midnight
6. To prevent entertainment being intrusive, noise emanating from the premises will not be clearly audible 1 metre from the facade of the nearest residential property.
Between 00.00hrs and 02.30hrs
7. Noise emanating from the premises will not be clearly distinguishable above back ground levels 1 metre from the facade of the nearest residential property.
8. Live music will cease at 22.00hrs
9. karaoke will cease at 23.00hrs
10. The outside area shall not be used by patrons after 23.30hrs for the purpose of an external drinking area
Conditions imposed by The Police Licensing Authority
Crime & Disorder
Whenever the designated premises supervisor is not at the premises another responsible person will be nominated by the designated premises supervisor as being the person to manage the premises.
A digital CCTV system that covers the public areas inside the premises will be maintained in good working order at all times including facial recognition either at the entrance or exit point. The images recorded will be of good quality and will be retained for 14 days and made available to the authorities on request.
The Police Licensing Department will be informed if the CCTV system is not working properly.
At least 2 SIA registered Frontline Door Supervisors will be on site any day of the week that the premises remain open after midnight until close.
Public Safety
A daily incident logbook detailing all incidents of note at the premises or in the immediate vicinity e.g. slips, accidents, entry refusals and incidents of disorder etc. The log will detail the date, time, type of incident, brief circumstances, action taken and person dealing. The logbook will be made available for up to six months Police or any other responsible authority for inspection, if required. All relevant incidents will be reported to the police at the earliest opportunity.
Public Nuisance
At least 15 minutes before the last sale of alcohol the atmosphere will be adjusted to create a calm period of wind down. An example will be the turning up of lights and switching off of any background music.
Protection of Children
Any person who looks or appears to be under the age of 21 shall be asked to provide identification that they are over the age of 18. The following are the only forms of identification acceptable:

Notices obtained from Police publicising the Challenge 21 initiate shall be clearly displayed at the entrance to the premises and behind the bar area at all times.
Children under the age of 18 years will not be allowed entry when any entertainment of an adult or sexual nature is taking place.
General
Police Officers will be afforded all possible assistance in the course of their investigations that relate directly to the premise.
