ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Steps that have been taken to promote the Four Licensing Objectives
(a) General - all four licensing objectives
The entertainment will be tasteful at all times, appealing to as wide an audience as possible within target age range.
Given also that the consumption of alcohol will be combined with food, the number of incidents of excessive alcohol related problems will be very limited.
(b) The prevention of crime and disorder
The ground floor entrance lobby, despite being a restaurant, is to be fitted with a compliant CCTV monitoring and recording system. Given quality of clientele, there will be no drinks promotions at the premises.
Tables will be cleared of all used glasses and bottles preventing removal from the premises.
There will be no admission to the premises after 10.30pm, thus minimizing the possibility of highly intoxicated persons entering the premises causing disorder either at the premises or upon leaving.
The toilets are to be checked every 30 minutes in any event which would additionally serve to minimize or eliminate possible substance abuse.
(c) Public Safety
Capacity will be limited to 150 persons in a spacious environment.
Used glasses and bottles will be removed from tables by the waiting staff.
The dining area will be ventilated by Daikin HRV units in accordance with building regulations. Temperature will be controlled via 4 Daikin air conditioning inverters, maintaining approximately 23ºC.
A gas interlock system will be fitted in the kitchen along with gas kill buttons at all kitchen exit points.
A bespoke compliant fire alarm system is to be fitted in accordance with the fire risk assessment report.
Emergency lighting will be installed in accordance with the fire risk assessment report.
(d) Prevention of public nuisance
A professional sound report has been undertaken. As a result of the report findings, an additional acoustic ceiling is to be fitted prior to opening.
No windows will be opened at the premises.
The premises will have a reception lounge capacity of 30 and given the spread of booking times, no queues are likely.
The winding down time is 90 minutes thus spreading the guest exiting period, avoiding nuisance.
Waste disposal will be via 1100ltr bins to the rear of the premises which will be emptied twice per week. Glass waste will be removed on a daily basis to a recycling centre.
All ventilation and air conditioning plant id to be mounted so as to reduce vibration.
The kitchen extract point has been situated as far away from the residential area as possible to minimize or prevent nuisance from any possible smell.
(e) Protection of children from harm
No children will be admitted to the premises after 7.00pm. Sunday lunch time, the age for admission will be restricted to 12 and over. Pre theatre dinner, the age will be restricted to 5 and over.
Staff will be trained in accordance with asking for ID for anyone appearing to be under 21.
Conditions that have been agreed with the Environmental Health Authority
Public Nuisance
Within two weeks of opening, sound testing will be carried out on a night when live entertainment is being held. The evening of the testing must simulate as far as is reasonably practicable the type of music and entertainment proposed, the level of occupancy expected and must involve use of the actual PA system and speakers. The operator must submit a full noise report to determine the adequacy of the acoustic ceiling and to confirm that they are able to meet the conditions applied to the licence.
Before 11pm
Any music including amplified and live music shall be permitted provided that the noise emanating from the premises shall not increase the background noise level (L90, 1hr) by more than 5dB(A), including the character and tonalities of the noise, as measured in the nearest residential property.
After 11pm
Total sound containment within the premises to achieve inaudibility in the adjoining premises.
Bands/performers will not be permitted to bring additional amplification to the venue. All musical instruments must be connected through the normal microphone inputs on the stage and must be subject to the Management's control at all times.
Management will ensure that the crowd participation i.e. singing/shouting is not encouraged. Guests will remain seated during performances and there will be no dance floor.
Management will provide the current on-site Unite Manager and any subsequent accommodation Management in the residential accommodation adjoining the premises with a contact telephone number for immediate response if there are any problems with noise disturbance from the property. The Management will then attend, verify and act to resolve any issues for example by reducing the volume.
There will be a maximum of 150 people at any time in the premises. In order to enter the premises the customer must purchase a meal. Only patrons with valid evening theatre tickets for that night may enter post theatre without a meal for the last 30 minutes of entertainment and the last hour of background music.
Suitable signage at the exit to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises.
Staff will check prior to entertainment, and periodically during the entertainment, that all windows and fire doors are shut.
Management will control the sound levels of the music/ entertainment.
Where plant and machinery has the potential to cause a noise problem it will be positioned in such a way that the building structure provides as much screening as possible for nearby noise-sensitive properties. Alternatively, or additionally, control measures such as acoustic enclosures, acoustic louvers, silencers, or additional acoustic screening will be considered.
Regular maintenance will be carried out on all plant and machinery to ensure that noise disturbance from such sources is kept to a minimum.
The delivery of goods is restricted to the normal working day.
The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night and during the early morning, when the noise generated could cause a nuisance particularly outside buildings.
Bottle skips and bins containing cans or bottles will not be emptied outside after 22.00 hrs but will be dealt with the next day during normal office hours.
The movement of bins and rubbish outside the premises will be kept to a minimum after 11.00pm.
Control of odour
Ventilation equipment will be regularly cleaned and maintained to control the levels of odour generated by the premises.
