ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
No adult entertainment
Conditions that have been agreed with the Environmental Health Authority
Public Nuisance
1. Doors and windows will be kept shut during entertainment
2. Suitable signage at the exit to request the co-operation of patrons to make as little noise as possible when leaving the premises
3. Door staff will be positioned at exits particularly at closing times
4. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment
5. Management will control the sound levels of the music/entertainment
6. Between midnight and 02.00hrs
Noise emanating from the premises will not be distinguishable above back ground levels one metre from the façade of the nearest residential property
Live Entertainment - Outdoors
1. Live Entertainment should be limited to ‘low key music’ typically classical guitarist and vocalist or traditional Jazz/Blues music, as stated in the application (Section E - Live Music)
2. Any one performance be limited to two house duration, inclusive of any breaks
3. Live entertainment to be limited to one event per day
4. After the completion of any live entertainment set, the event will not be followed with the playing of recorded amplified music outside the premises, within the control of the licensee
5. Live entertainment shall not be permitted beyond 22.30
6. Live entertainment shall be incidental to the use of the premise for the entertainment of patrons using the canopied area
7. Patrons should not be allowed to congregate on the public highway and paved areas outside as a consequence of the live entertainment.
Conditions that have been agreed with the Police Licensing Authority
1. Chairs and Tables may only be placed within the confines of the existing seating area bordered by glass screening.
2. No other furniture may be placed on to the footpath or access road without the written consent of the police, Sutton Harbour and Fire Service.
3. The use of the external seating area will not commence before the start of normal trading hours and will cease at 11pm.
4. A designated member of staff will be responsible for ensuring that customers remain seated within the designated seating area at all times.
5. No open or sealed vessels containing alcoholic drinks to be taken outside the premises, unless they are to be consumed within a designated external licensed seating area.
6. Any live music performed within the outside seating area must not be amplified to a level so as to be heard beyond the designated seating area.
7. Live music volume must be limited so as to not impact on customers enjoyment of adjacent external seating areas or other residents within the locality.
8. The manager or designated member of staff is responsible for managing and controlling the customers use of the outside seating area.
9. No customer shall be permitted to take drinks from the licensed premises unless they are able to consume the drinks whilst seated within the designated seating area.
10. No glassware or glass bottles to be taken from the premises or served by staff service away from the bar on all bank holidays, Sundays preceding them, Christmas Eve, New Years Eve and at times of local festival activities and events.
11. At times when glassware is permitted for use outside the premises toughened or safety glassware will be used.
Steps that have been taken to promote the Four Licensing Objectives
The Prevention of Crime and Disorder
1. A zero tolerance towards illegal drugs will be enforced at all times
2. If a disc jockey is used on any night then he/she will ask customers to leave quietly
3. If a CCTV system is installed at this site, it will continue to operate during the additional hours of trading and notices will be displayed
4. CCTV recordings will be kept for 28 days
5. The Police Licensing Department will be informed if the CCTV is not operating to full effectiveness
6. A copy of the CCTV recordings will be made available to Police on request
7. All instances of crime and disorder will be reported to the police and will be kept in an incident log book
8. The use of the external seating area shown on the attached plan will cease at 23.30 each day
9. The sale or supply of alcohol within the external seating area is restricted to customers who must be seated at the tables and chairs provided for that purpose
Public Safety
1. All staff are trained to the standards required by the relevant legislation
2. Free drinking water will be available at all times
The Prevention of Public Nuisance
1. Additional patrols will take place by members of staff, internally and externally, to limit any noise pollution when entertainment is being offered within the premises
2. If appropriate, notices will be displayed asking our customers to respect our neighbours when leaving the premises
3. Where already used text/radio pagers will continue to be used for the additional hours of trading and will be monitored by a responsible member of staff
4. Soft drinks and non-alcoholic refreshment will be available if we decide to use the option to stay open for an extended period between the cessation of the supply of alcohol and the closure of the premises
5. Live music outside the premises will be restrained in volume and is intended to provide music by way of background entertainment for diners in the external seating area.
The Protection of Children from Harm
1. When children are allowed upon the premises, any entertainment offered within the premises will be suitable for young persons
2. Children will be required to be supervised by the accompanying adult at all times
3. A no-smoking area will be provided
4. Soft drinks and non-alcoholic drinks will be available
5. Drinks will be supplied to children in plastic glasses or bottles
6. A recognised Proof of Age Policy will be enforced
