+ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Conditions that have been agreed with the Environmental Health Officer
The provision of late night refreshment should cease at 23.30hrs
The provision of regulated entertainment and of entertainment facilities should cease at 23.00hrs with the exception of (f) recorded music, which should consist of only background music after 23.00 hrs
The use of the cooking appliances will be interlocked to the kitchen extract ventilation system, which will cease operation at 23.30 hrs
Before 23.00 hrs the noise emanating from the premises from regulated entertainment will not be clearly audible one metre from the façade of the nearest residential property
After 23.00 hrs until 08.00 hrs there will be total sound containment within the premises from regulated entertainment
Conditions that have been agreed with the Trading Standards Authority
Premises to implement a ‘Think 21 policy’. All customers who appear under 21 years of age shall be asked to produce photo ID to purchase alcohol. Appropriate signage shall be positioned in the premises alerting customers to this policy.
All staff should be trained in the legality and procedure of alcohol sales, using the SWERCOTS training pack or equivalent, prior to undertaking the sale of alcohol and then at least every six months. Training should be signed and documented and documentation should be made available to an enforcement officer on request.
A refusal register shall be kept and shall include details of alcohol sales refused and the reason for refusal. The refusals register should be made available to an enforcement officer on request.
Staff are to ensure that adults are not purchasing any alcohol for under 18s. Proxy sales (as this is known) is fast becoming one of the biggest concerns with under age sales and carries serious consequences
Steps that have been taken to promote the Four Licensing Objectives
Public Safety
The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure their safety.
Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker should operate at a current not exceeding 30mA and should comply with BS4293. The device must be tested quarterly and tests will be recorded.
The gas system including appliances will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
All safety certificates and inspection reports will be kept on site and made available for inspection by officers of the relevant statutory bodies.
Provision for disabled patrons will be provided where it is reasonably practicable for disabled access to the premises and sanitary facilities
The sanitary accommodation consists of:
Second Floor: Male WC’s - 1, Male Urinals -1, WHB - 1,
Female WC’s 1, WHB - 2, also one accessible toilet and hand basin for use by all (including disabled access). The location of the facilities are indicated on the attached plan.
All sanitary accommodation will be maintained in good working order
Suitable and sufficient lighting will be provided to the toilets
Provision will be made for the collection and disposal of sanitary towels
Suitable and sufficient ventilation will be provided to the toilets
First aid provision will be available for the use of patrons
CCTV will be provided to enhance the safety of patrons and staff where deemed appropriate
Facilities for depositing litter and the collection of litter generated by patrons will be available and maintained
The Prevention of Public Nuisance
The second floor to be sound proofed
Doors and windows will be kept shut during entertainment
Suitable signage will be positioned at exits to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises
Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly
An announcement will be made prior to closing requesting patrons’ cooperation in leaving the premises and vicinity as quietly and quickly as possible
Entrances are provided with lobbies with automatic door-closers. The lobbies are in use throughout the time of entertainment
The emergency exits are well fitted and are kept shut during opening hours
A specific taxi operator has been nominated for staff and customers use. The company’s telephone number is advertised to customers. The operator, and all drivers, are aware that they should arrive and depart as quietly as possible, should not sound vehicle horns as a signal of their arrival or leave engines idling unnecessarily. In addition, staff will leave as quietly as possible, particularly at night and early in the morning.
Staff will check prior to entertainment and periodically during the entertainment that all windows and doors are shut
Management will control the sound levels of the music/entertainment
Provision of mechanical ventilation and air conditioning systems will not allow noise breakout from the premises or cause a nuisance by its operation
The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night and during the early morning, when the noise generated could cause a nuisance particularly outside buildings
Bottle skips and bins containing cans or bottles will not be emptied outside after 11.00pm but will be dealt with the next day during normal office hours
Ventilation equipment will be regularly cleaned and maintained to control the levels of odour generated by the premises.
All the rubbish produced by the premises will be stored securely in a designated area or in a bin with a tight-fitting lid
All commercial waste collection will be arranged for after 08.00am
